Since the implementation of the "Guiding Opinions of the Ministry of Emergency Management on Further Strengthening Work Safety Reporting", all localities have further established and improved the work safety reporting mechanism, encouraged reporting of major accident hazards and work safety violations, and further created a strong atmosphere for everyone to participate in work safety supervision. Recently, the Ministry of Emergency Management selected and announced 6 work safety reporting cases that were seriously investigated and dealt with by various localities.
Case 1: Reporting and investigating failure to conduct safety review in accordance with the law
In January 2024, the Luxi County Emergency Management Bureau in Hunan Province received a report from the public, reporting that a reconstruction project of a high-tech company in Luxi County did not carry out the "three simultaneous" safety evaluation of the safety facilities of the construction project. Upon investigation, the company began to reconstruct the production process and equipment in October 2023, and the production products were changed from red phosphorus to flame retardants. It did not entrust an institution with the qualifications required by the state to conduct a safety evaluation of the reconstruction project, and the safety conditions were not reviewed by the work safety supervision and management department. The report was true. The above behavior violated Article 12 of the "Regulations on the Safety Management of Hazardous Chemicals", and the Luxi County Emergency Management Bureau imposed administrative penalties in accordance with the law.
If a whistleblower discovers and reports a production and operation unit’s illegal production safety behavior, in accordance with the "Luxi County Production Safety Reporting Reward Measures", the Luxi County Emergency Management Bureau will reward the whistleblower with 5,000 yuan in January 2024.
Case 2: Reporting and investigating major accident hazards in coal mines
In September 2023, the Xinjiang Uygur Autonomous Region Emergency Management Department received a report from the public, reporting that a coal mine concealed the number of people going down the mine and there was a major accident hazard. After receiving the report, the Xinjiang Uygur Autonomous Region Emergency Management Department transferred the report to the Xinjiang Bureau of the State Administration of Mine Safety in accordance with the relevant provisions of the "Implementation Rules for Rewards for Reporting Safety in Mine Production". After investigation, in order to avoid the timeout alarm of the personnel position detection system, each team arranged one person to carry the positioning card of other personnel to go up the mine and sign the entry and exit signature record on behalf of the coal mine, resulting in the actual number of underground workers being inconsistent with the personnel position detection system and the number of people counted in the entry and exit record book. According to Article 18, Item 5 of the "Standards for Determining Major Accident Hazards in Coal Mines", it is a major accident hazard in coal mines, and the report is true. The above-mentioned behavior violates the provisions of Article 8, Paragraph 2, Item 1 of the "Special Provisions of the State Council on Preventing Coal Mine Production Safety Accidents", and the Xinjiang Bureau of the State Administration of Mine Safety has imposed administrative penalties in accordance with the law.
The whistleblower discovered and reported a major accident hazard in a production and operation unit. In accordance with the "Implementation Rules for Rewards for Reporting on Mine Safety Production", the Xinjiang Bureau of the State Administration of Mine Safety will reward the whistleblower with 256,056 yuan in April 2024.
Case 3: Reporting and investigating unlicensed production of hazardous chemicals
In December 2023, the Emergency Management Bureau of Xiapu County, Fujian Province received a report from the public that a rosin factory in Xiapu County produced hazardous chemicals without a license. Upon investigation, it was found that the rosin factory had one set of turpentine production equipment and 82 barrels of turpentine on site. Upon inspection, the turpentine produced by the rosin factory was a flammable liquid listed in the "Catalogue of Hazardous Chemicals". The rosin factory produced hazardous chemicals without obtaining a hazardous chemical production safety license, and the report was true. The above behavior violated Article 2 of the "Regulations on Production Safety Licenses", and the Xiapu County Emergency Management Bureau imposed administrative penalties in accordance with the law.
The whistleblower discovered and reported the production and operation unit’s illegal production safety activities. In accordance with the "Ningde City Production Safety Reporting Reward Measures", the Xiapu County Emergency Management Bureau will reward the whistleblower with 15,000 yuan in April 2024.
In January 2024, the Gansu Provincial Emergency Management Department received a report from the public, reporting that a new material company in Qin'an County, Tianshui City, illegally produced and a collapse accident occurred, causing one death. It was not reported in accordance with the law and was suspected of concealing the accident. Upon investigation, it was found that the company had a production safety accident in July 2023 that killed one person, concealed the accident that had occurred, and failed to report it to the emergency management department and other departments responsible for safety supervision within the prescribed time limit. The report was true.
The whistleblower discovered and reported the production and operation unit's concealment of an accident. In accordance with the "Gansu Province Safety Production Reporting Reward Measures", the Gansu Provincial Emergency Management Department will reward the whistleblower with 30,000 yuan in April 2024.
Case 5: Reporting and investigating the failure to design and construct safety facilities in accordance with the approval
In April 2024, the Ningnan County Emergency Management Bureau in Sichuan received a report from the public that a mining company in Ningnan County did not construct the mine in accordance with the facility design, which posed an accident hazard. Upon investigation, it was found that the mine of the company was not constructed in accordance with the approved safety facility design, and the original mining site did not leave pillars between the mining sites and the pillars in the mine room according to the design, which posed a major safety hazard. The above-mentioned behavior violated the first paragraph of Article 34 of the "Work Safety Law of the People's Republic of China" and Article 14 of the "Mine Safety Law of the People's Republic of China". The Ningnan County Emergency Management Bureau imposed administrative penalties in accordance with the law.
The whistleblower discovered and reported the production and operation unit’s illegal production safety activities. In accordance with the "Ningnan County Production Safety Reporting Reward Measures", the Ningnan County Emergency Management Bureau will reward the whistleblower with 20,000 yuan in April 2024.
Case 6: Reporting and investigating illegal storage of hazardous chemicals
In February 2024, the Tianjin Emergency Management Bureau received a report from the public, reporting that a certain industrial and trade enterprise in Beichen District illegally stored hazardous chemicals, posing a safety hazard. Upon investigation, it was found that diesel and CLEANSOLHS cleaning agents were stored in the warehouse of the enterprise. After comparing the safety technical instructions for the above chemicals provided by the enterprise and the "Catalogue of Hazardous Chemicals", and the relevant contents of the announcements of 10 departments including the Ministry of Emergency Management of the People's Republic of China, the above two chemicals are hazardous chemicals, both of which are dangerous to emit flammable gases and flammable vapors. The storage site is not equipped with a flammable gas detection and alarm device, which does not meet the requirements of Item 8.3.3 of the "General Code for Building Fire Protection". The report is true. The above-mentioned behavior violates the provisions of Article 20, Paragraph 1, and Article 32 of the "Regulations on the Safety Management of Hazardous Chemicals". The Beichen District Emergency Management Bureau has imposed administrative penalties in accordance with the law.
The whistleblower discovered and reported the illegal production safety violations of the production and operation unit. In accordance with the "Tianjin Emergency Management Bureau's Production Safety Reporting Reward Regulations", the Tianjin Emergency Management Bureau will reward the whistleblower with 9,000 yuan in May 2024.
