Today, the People's Procuratorate of Xuhui District, Shanghai held a press conference on "Rule of Law and Co governance - Cybersecurity and Space Governance", reporting on the performance of cyberspace governance prosecutors from 2020 to 2022.
From 2020 to 2022, the Xuhui Procuratorate handled a total of 1966 cases involving 2583 individuals in cybercrime, accounting for 31.5% of the total number of criminal cases received. The proportion of cybercrime cases increased by an average of 13% annually. Among them, telecommunications network fraud and related crimes have surged, accounting for over 70% of network crime cases for three consecutive years; The trend of crimes that threaten data security is on the rise, with pure computer network crimes such as illegal acquisition of computer information system data, destruction of computer information systems, provision of intrusion, illegal control of computer information system programs, tools, and illegal use of information networks increasing by 40% year-on-year in 2022; The use of the Internet to commit pornography, gambling and drug crimes accounts for 30%, and the Internet has become a new field for traditional crimes such as pornography, gambling and drugs; Crimes related to online intellectual property rights are increasing year by year, with trademark related crimes accounting for 66.7% of cases of intellectual property infringement committed through the use of the internet. The number of cases of online counterfeit sales has exceeded that of traditional offline counterfeit sales models.
The Xuhui Procuratorate also released a typical case of infringing on the personal information of citizens. In 2021, the defendant Hu purchased the mobile phone numbers and other information of POS machines from companies such as Shanghai Data Service Co., Ltd. from Cao through the internet, and then sold them to Duan and others for profit through the internet. Hu sold information to Duan and received more than 130000 yuan. After purchasing information from Hu and others, Duan not only used it for his POS machine promotion business, but also sold or provided it to multiple people such as Li, Sun, and Zhang. After investigation, Duan sent over 600000 pieces of personal information of citizens to others through WeChat.
After being prosecuted by the Xuhui Procuratorate in accordance with the law, Hu was sentenced to 3 and a half years in prison and fined 130000 yuan for the crime of infringing on citizens' personal information.
