Zhang is an operator in the gold-plated production workshop of a certain circuit board factory. He is mainly responsible for gilding mobile phone circuit boards, which means immersing the circuit boards into the gold-plated slots of the production line. Every time he goes to work, Zhang scoops the gold solution from the plating tank three times and sends it to the chemical laboratory for testing. Looking at the gold solution in his hand, Zhang became greedy.
One day in August last year, Zhang took advantage of the absence of people on the night shift and used a beaker to scoop out a cup of gold solution from the gold-plating tank, pour it into a rubber glove, and seal it. When he was about to finish work, he hid gloves containing gold solution in his pants, passed through security checks on the production line, hid the gloves in the changing room, and then took them away from the workplace. According to Zhang's confession after arriving at the case, he was able to steal 3-5 liters of gold solution in one night and store it in the trunk of his vehicle. After accumulating a certain amount, he sold it to his old friend Wang.
Wang specializes in second-hand gold recycling and trading. After receiving the gold solution provided by Zhang, they began to refine it and paid 85% of the market price for the extracted gold. At the beginning of this transaction, Zhang personally told him that these were gold solutions from the circuit board factory.
In March of this year, the security supervisor of the company discovered during an inspection in the monitoring room that Zhang had filled a cup of gold solution with a measuring cup and placed it in a sampling bucket, preparing to put it into rubber gloves. The supervisor noticed something was wrong and immediately called the police. Zhang was arrested on the spot, and Wang voluntarily surrendered to the police station afterwards. After arriving at the case, Zhang and Wang confessed to the facts of the crime and refunded approximately 110000 yuan and 20000 yuan respectively to the victim's unit.
The Minhang Procuratorate believes that from the second half of 2022 to March 2023, Zhang took advantage of his position as an operator on the company's gold plating production line to package the gold solution in the plating tank into rubber gloves, hide it in his pants, and take it out of the company in batches before selling it to the defendant Wang. Knowing that the gold solution was stolen by Mr. Zhang from the company, Mr. Wang still purchased it from Mr. Zhang, the suspect, at a discount of 8.5% of the gold market price, and paid more than 110000 yuan of stolen money in cash, WeChat transfer and other ways. Considering that Zhang and Wang voluntarily pleaded guilty and returned all illegal gains, and after being prosecuted by the Minhang Procuratorate, the defendants Zhang and Wang were ultimately sentenced to the aforementioned punishment.
