Two departments standardize the management of large-scale performance activities: the proportion of ticket sales to the public shall not be less than 85%
In order to strengthen the standardized management of large-scale commercial performance activities with an audience of over 5000 and promote the healthy and orderly development of the performance market, the Ministry of Culture and Tourism and the Ministry of Public Security jointly issued a notice on further strengthening the standardized management of large-scale commercial performance activities and promoting the healthy and orderly development of the performance market.
The Notice points out that currently, the performance market is rapidly recovering and developing, with a significant increase in large-scale commercial performance activities such as concerts and music festivals. While meeting the spiritual and cultural needs of the people, some performance activities also face prominent issues such as ticket speculation, irrational star chasing, and uncivilized performances. It is required that according to the principle of "whoever hosts the event is responsible", the performance hosting unit should strictly implement the safety main responsibility, strictly establish and implement safety management systems, clarify safety responsible persons, and establish and improve risk assessment and emergency response mechanisms.
The Notice makes the following clear requirements for strengthening ticketing management:
Large scale performance activities implement a real name ticket purchase and real name admission system. Each ID card can only purchase one ticket for each performance, and the identity information of the ticket buyer and the entrant should be consistent. Performance organizers and ticketing sales platforms should strengthen the protection of consumer personal information to prevent unauthorized access, as well as personal information leakage, tampering, and loss;
The hosting unit of the performance shall establish a ticket refund mechanism for large-scale performance activities, set reasonable tiered refund fee standards, and ensure the legitimate refund rights of ticket buyers;
Further increase the proportion of ticket sales for large-scale performance events, and the number of tickets publicly sold by the hosting unit to the market shall not be less than 85% of the approved audience. For the remaining 15% of the tickets, personal information should be bound 24 hours before the performance, achieving "real name binding and real name entry";
The hosting unit of the performance shall clearly indicate its authorized ticketing agency and guide consumers to purchase tickets from legal channels. Should fulfill the obligation to inform consumers of the rules for purchasing, entering, and refunding tickets;
The cultural and tourism administrative departments should urge performance organizers and performance ticketing sales platforms to transmit real-time ticketing information of large-scale performance activities to the national cultural market technology supervision and service platform, and further strengthen ticketing information management of large-scale performance activities;
The cultural and tourism administrative departments and public security organs should strengthen the management of large-scale performance event organizers and local work tickets, strictly control the scope of issuance, and prevent work tickets from entering the market and being illegally traded.
The Notice requires cultural and tourism market management departments and comprehensive law enforcement agencies to strengthen on-site inspections of large-scale performance activities, verify actor information and performance program content on site, strictly prohibit unauthorized changes to actors and performance content, and strictly prohibit illegal and irregular behaviors such as lip syncing and fake performance; Intensify efforts to crack down on illegal activities; The cultural and tourism administrative departments should strengthen the management of performance ticketing sales platforms, and lawfully dispose of violations such as failure to fulfill the obligation to verify the qualifications of ticketing operating units and performance approval documents, and providing services for ticket scalping; The public security organs should increase their efforts to crack down on the scalping of performance tickets, comprehensively collect information on scalping and hyping tickets online and offline, timely discover clues of ticket price increases or disguised price increases, and strictly crack down on illegal and criminal activities such as online and offline ticket scalping and fraud.
The Notice also stipulates that the cultural and tourism administrative departments shall, in accordance with the Regulations on Credit Management of the Cultural and Tourism Market, recognize performance organizers and ticketing agencies that sell less than 85% of the approved number of tickets to the public or provide convenience for reselling tickets or buying and selling performance work tickets in large-scale performance activities as dishonest entities in the cultural and tourism market in accordance with the law. Guide the audience to watch the performance in a civilized manner, and advocate that actor agencies and related performance agency practitioners should strengthen education and reminders for actors, actively guide them to always respect the legal red line and strictly abide by the moral bottom line. Encourage actors to speak up actively, guide the audience to comply with the management regulations of the performance site, and jointly maintain the order of the performance.
