The draft laws reviewed by the Standing Committee of the National People's Congress have been publicly solicited for comments, and have been normalized and institutionalized. Article 40 of the Legislative Law stipulates: "A legal bill that is included in the agenda of a standing committee meeting shall be made public to the public for comments after the standing committee meeting, including the draft law and its drafting and modification explanations, except for those decided not to be made public by the chairman's meeting. The time for soliciting opinions to the public shall generally not be less than 30 days. The situation of soliciting opinions shall be reported to the public."
From August 28 to September 1, 2023, the Standing Committee of the 14th National People's Congress held its fifth meeting to review the Company Law, Value Added Tax Law, Preschool Education Law, Degree Law, and Public Security Management Punishment Law. At present, the full text of the five draft laws mentioned above has been published on the website of the National People's Congress of China, and opinions are publicly solicited from September 1st to September 30th. The general public can directly log in to the website of the People's Congress of China or the national legal and regulatory database to provide opinions, or they can send their opinions to the Legal Work Committee of the Standing Committee of the National People's Congress.
The public's comments on the draft law through normal channels are a concrete manifestation of the public's concern and orderly participation in national legislative work, which is of great significance. The legal work organization of the Standing Committee of the National People's Congress will carefully review and study the various opinions and suggestions put forward by the public and relevant parties on the draft law for soliciting opinions, including the opinions and suggestions on the clauses that have attracted attention, and propose suggestions for modification, improvement or proper handling. The Constitution and Law Committee of the National People's Congress, based on the deliberation opinions of the Standing Committee of the National People's Congress and relevant special committees, as well as the opinions put forward by various parties, conducts unified deliberation on the draft law, reports on the revision status or the results of the deliberation, and submits the revised draft law to the Standing Committee for deliberation in accordance with legal procedures.
