After the Eryuan County Court in Dali, Yunnan Province reported that a law enforcement officer had hit and run a police car, some doubts about the case have sparked further discussion among netizens. At present, the Discipline Inspection Commission and Supervision Commission of Eryuan County have intervened in advance and are currently investigating and handling the matter.
According to a previous report by Pengpai News, on the afternoon of August 31st, Li Mouliang and three other judicial police officers from Eryuan County Court went to the detention center in Eryuan County to perform their official duties. At around 15:30, while driving a police car to the Micz Line, Li and his light rail truck collided on the side during a meeting. After the incident, the police car did not slow down and drove away from the scene, resulting in being judged by the traffic police as a "hit and miss".
On September 8th, the Eryuan County Court publicly opened a report stating that the accident caused varying degrees of damage to two vehicles. The Traffic Police Brigade of the Eryuan County Public Security Bureau issued the "Road Traffic Accident Determination" and "Public Security Traffic Management Administrative Penalty Decision", determining that Li Mouliang was fully responsible for the accident. For his illegal behavior of escaping after the traffic accident and not yet constituting a crime, he was fined 1000 yuan and his driver's license was scored 6 points. After the accident, Li sincerely apologized to Li, and the traffic police department presided over the mediation between the two parties. On the afternoon of September 6th, both parties reached a compensation agreement and fulfilled it. The court has criticized and educated Li Mouliang, ordering him to deeply reflect and will handle him in accordance with relevant regulations.

According to Hu Lei, a lawyer from Sichuan Dingchi Law Firm, the revised "Yunnan Province Road Traffic Safety Regulations" passed in November 2022 have clear provisions on the nature of behavior of drivers in Eryuan County Court.
Article 66 of the Yunnan Provincial Road Traffic Safety Regulations stipulates five types of traffic accident and escape behaviors, among which the first one is "knowingly driving away from the scene of a traffic accident or abandoning the vehicle to avoid legal responsibility". From the specific situation of this case, it can be seen that the court's car collided with the truck during the meeting. From a common sense of life, the driver of the police car could not have been unaware. Although the traffic police did not clearly state "hit and run" in the subsequent notification, it was also confirmed that the police car had left the scene without stopping or reporting to the police. According to legal provisions, this is a very serious type of hit and run.
Hu Lei stated that whether the Eryuan County Court reported the accident situation to the public security traffic management department in accordance with the law as soon as possible after the incident should also be investigated thoroughly. According to Article 67 of the Yunnan Province Road Traffic Safety Regulations, if a party escapes after a traffic accident, the informed accompanying person, unit leader, vehicle owner, manager, etc. should immediately report to the traffic management department of the public security organ.
Regarding the punishment imposed by the traffic management department on Li Mouliang, Hu Lei analyzed that the punishment was too light. Article 99 of the Road Traffic Safety Law stipulates that if there is a hit-and-run behavior, the traffic management department shall impose a fine of not less than 200 yuan but not more than 2000 yuan, and also impose detention of not more than 15 days. The Yunnan Provincial Road Traffic Safety Regulations refine this regulation to impose a fine of not less than 1000 yuan but not more than 2000 yuan on drivers of motor vehicles who cause accidents and escape; Detention for up to 15 days simultaneously. Hu Lei stated that based on the punishment results reported so far, Li's behavior has a relatively bad nature. However, not only was the fine only given at the lowest level, but the administrative detention was not given for a day. The punishment is indeed relatively light, and the truck driver can file a request for review and reconsideration with the traffic management department in accordance with the law.
