The Zhoucun District Court of Zibo City publicly tried two cases of job-related crimes
Recently, the Zhoucun District Court in Zibo City held public hearings on the case of defendant Li Yapeng committing bribery and corruption, and defendant Sha Hongmin committing bribery and corruption.
Accusations from prosecution authorities
1. Bribery crime
From April 2015 to January 2023, the defendant Li Yapeng took advantage of his position as the Secretary of the Party Committee, Vice Dean, Chairman, Commander in Chief of the New Campus Construction Project Command, and Executive Director of Shandong Qilu Medical Education Technology Co., Ltd. to seek benefits for relevant units and individuals in engineering project contracting, project bidding, business development, and work arrangement, and requested and received gifts from relevant units and individuals, with a particularly large amount.
From August 2009 to March 2023, the defendant Sha Hongmin took advantage of his position as Director of the Enrollment and Employment Guidance Office of Shandong Wanjie Medical College, Director of the Enrollment Office of Qilu Medical College, Director of the New Campus Construction Command Office, and General Manager of Shandong Qilu Medical Education Technology Co., Ltd. to seek benefits for relevant units and individuals in cooperative education, enrollment, engineering acceptance, and work arrangement. He received cash and transfers from relevant units and individuals, with a huge amount.
The prosecution believes that the actions of the defendants Li Yapeng and Sha Hongmin have both constituted the crime of bribery and should be convicted and punished in accordance with Article 385 of the Criminal Law of the People's Republic of China.
2. Crime of corruption
From April 2010 to January 2022, the defendant Li Yapeng took advantage of his position as Vice Dean of Shandong Urban Service Technology College, Secretary of the Party Committee, Vice Dean, Chairman of the Board, Commander in Chief of the Command, and Executive Director of Shandong Qilu Medical Education Technology Co., Ltd. to falsely claim and withhold income, and illegally possessed public funds alone or in conjunction with others, resulting in a huge amount.
In January 2022, the defendant Sha Hongmin took advantage of his position as the General Manager of Shandong Qilu Medical Education Technology Co., Ltd. and, together with the defendant Li Yapeng, adopted a method of withholding income without entering the account, transferring the consulting service fee for the Russian study abroad project of Shandong Qilu Medical Education Technology Co., Ltd. to the account of a third-party company controlled by the defendants Li Yapeng and Sha Hongmin, illegally taking possession of it, with a huge amount.
The prosecution believes that the actions of the defendants Li Yapeng and Sha Hongmin have both constituted the crime of corruption and should be convicted and punished in accordance with Article 383 of the Criminal Law of the People's Republic of China.
Trial process
During the trial, the defendants Li Yapeng and Sha Hongmin acknowledged the facts and charges of the crime charged by the prosecution and expressed remorse in court. The prosecution presented relevant evidence, the defendant and defense counsel conducted cross examination, and both the prosecution and defense fully expressed their opinions under the auspices of the court. The defendant made a final statement.
