Since 2001, Zhang Mouhao has gradually absorbed many social forces with Zhang Mouhua, Liu Mouhua, Zhang Moudong and Zhang Mouping as the backbone, and formed a criminal organization with Zhang Mouhao as the organizer and leader. Starting from 2001, in order to maintain long-term control over grassroots political power, Zhang Mouhao actively intervened and manipulated the election of previous village committee elections in Basuo Village, Basuo Town, Dongfang City. Zhang and others also illegally purchased and sold a large amount of collective land in eight villages through previous village directors.
The defendant Zhang, as the organizer and leader, used his clan power and the power of family members as leaders of government departments to provide support and shelter for members of the organization to commit illegal crimes. Backbone members led subordinate members to carry out a total of 63 criminal acts and 3 illegal acts, including illegal transfer, sale of land use rights, and illegal occupation of agricultural land, in the eight areas of Dongfang City. Through illegal activities, they illegally accumulated nearly 100 million yuan and have strong economic strength. The illegal gains are used to support the operation and development of the organization.
The organization has been entrenched in the eight regions for more than 20 years, engaging in misconduct and dominating one side. Its illegal and criminal activities have resulted in one death, one serious injury, and multiple minor or minor injuries; Disturbance and manipulation of grassroots organization elections, rampant encroachment on the collective land use rights of Basuo Village, serious damage to the land, mineral resources and other resources of Basuo Village, illegal control of Basuo Port freight business, and serious damage to grassroots governance, economic and social order in the Basuo area of Dongfang City.
The Intermediate People's Court of Haikou City has made the above judgment in accordance with the facts, nature, circumstances, and degree of harm to society of each defendant's crime, combined with the circumstances of pleading guilty and accepting punishment.
