If it weren't for December 1st, 2020, 49 year old Zhu Lichun might still have worked calmly at a pharmacy, selling goods during the day and working night shifts.

But on that night, she found out that thirty years ago, her admission letter for the high school entrance examination was falsely claimed, and another "Zhu Lichun" "promoted her to a vocational school and entered the Agricultural Bank of China. Zhu Lichun's world has begun to become imbalanced, "for three years, there has never been a day when my mood has been calm.".

A life that has been "subverted"

December 1st, 2020 is a day that Zhu Lichun will never forget. Around 16 o'clock, a man and a woman entered the pharmacy where she worked, and asked her seriously if it was Zhu Lichun. Zhu Lichun said that it was already dark and she was the only one in the pharmacy. Perhaps out of fear, she shook her head and denied it.

That night, two more people came to the pharmacy, one of whom was Zhu Lichun's neighbor. "My neighbor brought a man and said he was the 'middleman'. The 'middleman' said that the woman who came this afternoon was also called 'Zhu Lichun', but she didn't have the same name as me, but stole my name and identity."

In the following narration of "middleman", Zhu Lichun heard about her thirty years of being "stolen". In the autumn of 1990, a woman impersonated Zhu Lichun's admission letter to Changchun Computer Vocational and Technical School and enrolled in the school. After graduating in 1993, she joined the Jilin Branch of Agricultural Bank of China Limited and was about to retire.

However, Zhu Lichun, who had been waiting at home for two months without receiving the admission letter, thought she had failed and was extremely disappointed. After a few years of lackluster living at home, she went out to work. Due to her lack of education, she has worked as a waitress, salesperson, and even picked up scrap when she was in the most difficult situation. "I have no education or technical skills, and I work part-time with low wages and no insurance, so I have never known about my identity being occupied," said Zhu Lichun. In 2005, Zhu Lichun got married and divorced. She took the self-study exam and started working in the pharmacy industry.

"When I heard that something like this happened, it felt like a bolt from the blue. I have suffered so much for so many years and lived such an unhappy life, all thanks to this fake Zhu Lichun," said Zhu Lichun.

Thirty years of being "stolen", who will pay back

According to the intermediary, recently, the Agricultural Bank of China Changchun Green Garden Branch discovered through internal inspection that "Zhu Lichun" had falsified her identity, which led to the opening of the matter. "The bank ordered her to resolve this matter within three days, otherwise she would be fired. The 'intermediary' said that the person who replaced me wanted to take part of her pension as compensation, but I refused." Zhu Lichun said, "I asked her to come and confront me personally, and we must take legal means."

The negotiation failed, and "Zhu Lichun" and "intermediary" no longer had a conversation with Zhu Lichun. On December 10, 2020, Zhu Lichun went to the medical insurance and social security departments to inquire and found that she did indeed have medical insurance, social insurance, and other insurance coverage under her name.

On March 12, 2021, Zhu Lichun visited the Agricultural Bank of China Changchun Branch to inquire about the situation, but did not receive a clear response. Subsequently, she went to the Xixin Police Station of the Green Garden Branch of the Changchun Public Security Bureau to report the case. On March 30th, the police station replied to her: the person who forged the ID card has been found, and she admitted to the act of forging Zhu Lichun's identity. The police have filed a case.

In July 2021, the Xixin Police Station informed Zhu Lichun that the person who forged his ID card was named Jie, and due to physical reasons, he had been released on bail pending trial. "This is the first time I know the name of the person who forged my identity," said Zhu Lichun. Over the past year, she repeatedly reported the situation to functional departments such as the Public Security and Financial Supervision Bureau.

On April 28, 2023, Zhu Lichun learned that the case had been dismissed, and wrote in the Letter of Decision on the Cancellation of the Case given to her by the Lvyuan Branch of Changchun Public Security Bureau: The 20210328 case of Zhu Lichun's identity being falsely used in Lvyuan District, Changchun City, handled by our bureau, was decided to cancel the case in accordance with Article 163 of the Criminal Procedure Law of the People's Republic of China because it was found that the suspect should not be investigated for criminal responsibility during the investigation process.

On July 24th, Zhu Lichun received the "Opinions on Handling Visiting Matters of Agricultural Bank of China Changchun Lvyuan Branch", which stated that Zhu Lichun, a former employee of Agricultural Bank of China, was hired as a savings agent in June 1993 and met the recruitment requirements at the time. Former employee of Agricultural Bank of China, Zhu Lichun, was absent from work for no reason and her labor contract was terminated in February 2021.

According to the "Handling Opinions", shortly after Xie contacted Zhu Lichun in December 2020, he was dismissed by the bank. "Shouldn't the bank be held responsible for using my identity to join the company? Just dismiss someone?" Zhu Lichun couldn't accept this response and applied to the Agricultural Bank of China Changchun Branch for a review. On August 11th, she received an application for review in the "Handling Opinion", which only stated the fact that Jie was dismissed and did not respond to Zhu Lichun's report of "identity being impersonated.". Zhu Lichun once again requested a review, but has not received the review result yet.

Why was Xie released on bail pending trial and withdrawn from the case? The reporter learned from the Changchun Public Security Bureau that the issue reported by Zhu Lichun was indeed true, but during investigation, the police found that the imposter, Jie, was pregnant and was released on bail pending trial. The case was later dropped.

Why do employees with identity fraud enter Agricultural Bank of China to work? Why was it discovered after working for nearly thirty years? Should the bank assist the victim and public security organs in handling the case of employee identity fraud? Why is the reason for dismissal due to "continuous absenteeism" when an employee's identity is found to be fake? If according to the police investigation, "Jie was pregnant in April 2021," is there a situation where Agricultural Bank of China fired pregnant employees when the labor contract was terminated in February 2021? On September 13th, the reporter called the contact phone number of Agricultural Bank of China Changchun Branch on the "Handling Opinions", but the staff could not provide a clear answer to the above questions. As of the time of publication on September 19th, the reporter had not received a response phone number from Agricultural Bank of China.

Regarding this, the reporter consulted multiple lawyers. The lawyer stated that the "Handling Opinions" of Agricultural Bank of China Changchun Branch and Green Garden Branch avoided the issue of employee Jie impersonating someone. The bank should be truthful and handle the termination of labor contract with Jie correctly, rather than dismissing him on the grounds of "continuous absenteeism", in order to respond to Zhu Lichun. At the same time, as it has become a fact that Jie has impersonated Zhu Lichun, Agricultural Bank of China has an obligation to assist relevant departments in handling Zhu Lichun's social security, medical insurance, housing provident fund and other issues, rather than just issuing a "handling opinion" to clarify the relationship.

How should Zhu Lichun go next? Lawyer Su Hang from Jilin Dajiang Law Firm stated that citizens have the right to their names and have the right to decide, use, and change their names in accordance with regulations. It is prohibited for others to interfere, steal, or counterfeit their names. At the same time, if a citizen's right to name, portrait, reputation, or honor is infringed upon, they have the right to demand cessation of infringement, restoration of reputation, elimination of influence, apology, and compensation for losses. Zhu Lichun's right to name has been infringed upon, and she can file a civil compensation lawsuit to claim compensation for mental damages.
