According to reports from netizens, the catering chain "Mustache Chef" has set up a "deceptive" button in the ordering mini program accessed through third-party technology systems, inducing consumers to default to becoming members and agreeing to member privacy policies, thereby further requesting personal information such as consumer phone numbers.
In response to the above issues, the Shanghai Cyberspace Administration stated on September 13 that it has jointly interviewed the person in charge of the "Hu è rd Chef" with the Xuhui District Cyberspace Administration in accordance with the law, requiring enterprises to establish and reform their systems, effectively fulfill their personal information protection obligations, and safeguard the legitimate rights and interests of consumers.
The Shanghai Cyberspace Administration also requires third-party ordering system technology service enterprises to optimize the design of product templates for the "member membership" process, inform consumers of their rights and obligations through clear identification, ensure their right to know and choose, and fully support catering enterprises in protecting the personal rights and interests of consumers. After verification, the issues related to the "Mustache Chef" have been rectified.
The relevant person in charge of the Shanghai Cyberspace Administration pointed out that such "zero yuan membership" behavior, which defaults to consumer consent, intends to induce consumers to complete the authorization of the enterprise unintentionally or without fully understanding the service content through a "deceptive" business process, which violates the "informed consent" principle of the Personal Information Protection Law.
Shanghai catering operators should comply with the "Shanghai Online Dining Service Consumer Personal Information Protection Compliance Guidelines" formulated and released by the Shanghai Consumer Protection Commission in conjunction with the Shanghai Catering and Cooking Industry Association, and improve their compliance awareness and protection level in all aspects of collecting, using, and storing consumer personal information.
