Suspended for two years, after a retrial of the Li Yuqian case, the first instance verdict was pronounced: sentenced to death for intentional homicide by Meng Ruihong | Civil Procedure | Li Yuqian
On September 6, 2023, the Intermediate People's Court of Liupanshui City, Guizhou Province publicly announced the first instance verdict on the defendant Li Yuqian, who was remanded for retrial by the Higher People's Court of Guizhou Province, for intentional homicide, Meng Ruihong for sheltering, and criminal incidental civil litigation. Li Yuqian was sentenced to death for intentional homicide with a two-year reprieve and deprived of political rights for life; Meng Ruihong was sentenced to eight years in prison for the crime of shielding. At the same time, a judgment shall be made in accordance with the law on the incidental civil part.
After the case was remanded for retrial, this court formed a separate collegial panel for trial in accordance with the law. During the trial, the opinions of the defendant, defense counsel, and prosecution agency were fully heard. After evaluation by the collegial panel and submission to the trial committee of this court for discussion, it was found that the intentional and illegal deprivation of life by the defendant Li Yuqian constituted the crime of intentional homicide. The defendant Meng Ruihong, knowing that Li Yuqian was a criminal, falsely proved to have sheltered him. The circumstances are serious, and his behavior constitutes the crime of sheltering. Li Yuqian's criminal behavior caused certain economic losses to the plaintiff in the incidental civil litigation, which should be compensated by Li Yuqian. However, due to the plaintiff's failure to provide relevant evidence in response to their lawsuit request in the incidental civil litigation, their economic losses are supported at their discretion. Meng Ruihong shall not be liable for civil compensation if she has not committed intentional homicide.
