Recently, the "non renewal of employment upon reaching the age limit" policy at Xunyang People's Hospital has attracted media and netizens' attention. Xunyang City quickly established a joint investigation team to conduct a comprehensive investigation and handling. The relevant situation is now reported as follows:
After investigation, Xunyang People's Hospital formulated the "Management Measures for Employment Personnel" in 2017. According to the provisions of the Measures, "except for clinical medical positions, all other positions where male employees are over 50 years old and female employees are over 44 years old will not be renewed", 19 employees were terminated. Among them, 15 were dismissed before 2022 and 4 were dismissed in 2023. There were issues such as failure to enter into open-ended labor contracts with eligible workers in accordance with the law, illegal termination of labor contracts, and calculation of economic compensation not in accordance with legal provisions, which violated the provisions of Article 14 (2), Article 39, Article 47, and Article 87 of the Labor Contract Law of the People's Republic of China. On September 1st, the Municipal Bureau of Human Resources and Social Security delivered the "Instruction for Labor Security Supervision to Correct within a Time Limit" to Xunyang People's Hospital, ordering it to revise the "Management Measures for Hired Personnel" within 15 days, and implement it after being approved by the competent bureau. The municipal joint investigation team ordered the Municipal People's Hospital to fully negotiate with the dismissed personnel and provide compensation in accordance with the law. At present, through mutual consultation, Xunyang People's Hospital has paid twice the economic compensation standard to 19 dismissed personnel.
