The unit involved responded that a police car in Eryuan, Yunnan was reported to have hit and run
Recently, a netizen reported that on August 31st, she had a side collision with a police car with license plate number Yun LAII8 on her way home from work. The car did not slow down at the time of the incident and fled afterwards. As a result, the traffic police determined that the other party had "hit and driven away".
According to media reports, government officials from Eryuan County stated that the police car involved was a vehicle of the Eryuan County Court in Dali City, and the driver was a police officer of the court.
On the morning of September 7th, the staff of Eryuan County Court responded to Upstream News reporters that they would handle the personnel involved and issue a notice.
Ms. Li, a netizen involved, told the media that around 3pm on August 31st, she was driving her vehicle back to Eryuan County when she met a police car. "At that time, I had already stopped to let him go, but he was driving very fast and didn't brake, so he rushed over and collided with my car. After the collision occurred, he not only didn't stop and get off to check, but also drove away directly."
Ms. Li immediately reported to the police and waited for nearly an hour for the accident police car to return to the scene. "My car's rearview mirror was damaged and there were scratches on the body," Ms. Li said. The accident also caused minor injuries to her body, and her colleague who was traveling with her injured arm. From the photo provided by Ms. Li, there are also scratches on the left side mirror of the police car involved.
The traffic police department determined that the involved police vehicles were fully responsible. However, Ms. Li questioned the statement made by the traffic police department that the police vehicle in question was deemed to have "caused an accident and left", and currently the other party has not provided a suitable solution.
According to the road traffic accident certification issued by the Eryuan County Traffic Police Brigade on September 3, on August 31, Li Mouliang drove a small ordinary passenger car with license plate number Yun LA118 police officer along the Miz Line from south to north. "The party involved, Li Mouliang, violated the traffic regulations and was the root cause of the accident, and should bear all the blame." The traffic police department determined that after the accident, Li Mouliang stopped without warning and drove the vehicle from the scene of the accident.
The accident determined that Li Mouliang was fully responsible for the accident, while Li Moujie was not responsible.
On the morning of September 7th, staff members of the People's Court of Eryuan County, Dali, Yunnan confirmed to upstream news reporters that the police car involved was indeed a vehicle of the unit. "The traffic police department has already determined the outcome of this matter. We will handle the personnel involved and issue a notice."
Regarding Ms. Li's questioning, the reporter called the staff of the Eryuan County Traffic Police Brigade, stating that to understand the situation, an official letter needs to be issued and a response can only be given at the brigade.
Lawyer Lin Xiaoming, a partner of Sichuan Yishang Law Firm, told Upstream News that "accident causing departure" is not a strict legal term, and may be an attempt to provide an objective description of the relevant accident process; Hit-and-run is a legally prescribed situation, and based on the specific process of the incident, the police car belongs to hit-and-run.
According to the Criminal Law, "the crime of traffic accident refers to the criminal act of the perpetrator violating traffic management laws and regulations, resulting in a major accident, causing serious injury, death, or causing significant losses to public and private property." If it does not constitute a crime, the traffic management department of the public security organ shall impose a fine of not less than 200 yuan but not more than 2000 yuan; if it constitutes a traffic accident crime, it shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years. From the process and consequences of the accident, it is considered as a traffic accident escape, but it has not yet constituted a crime.
"In the event of a traffic accident, one should immediately stop the car to report to the police or assist the injured, instead of leaving the scene directly. As a police officer, one should abide by the law and take a leading role as a model." Lawyer Lin Xiaoming said.
