After trial and investigation, it was found that from 2013 to 2020, the defendant Chu Yinliang took advantage of his position as Ninghai County Magistrate, County Party Secretary, Deputy Mayor of Ningbo City, Standing Committee Member of Ningbo City Party Committee, and Secretary of Yinzhou District Party Committee to seek benefits for relevant units or individuals in project promotion, state-owned asset investment, land transfer, and other matters, illegally accepting property from others, with a total value of RMB 12.6 million; From 2018 to 2020, during his tenure as a member of the Standing Committee of the Ningbo Municipal Party Committee and Secretary of the Yinzhou District Party Committee, Chu Yinliang instructed relevant government department heads to illegally establish for-profit kindergartens, break policies, provide venues, and issue school licenses for others in order to help them seek economic benefits, causing adverse social impacts; In addition, Chu Yinliang also provided property to state officials in order to seek illegitimate benefits.
The court believes that the defendant Chu Yinliang's behavior constitutes the crime of bribery, abuse of power, and bribery, with a particularly large amount of bribery. The abuse of power has caused adverse social impact, and the circumstances of bribery are particularly serious. Considering that Chu Yinliang voluntarily confessed to the supervisory authorities the fact that he had not yet mastered the bribery crime, which was a voluntary surrender, and the bribery crime was not successful due to reasons beyond his will, it was an attempted crime. He voluntarily confessed to most of the bribery facts that the supervisory authorities had not yet mastered, apologized, actively withdrew all illegal gains and profits, and demonstrated meritorious service.
