How to protect and stimulate the vitality of market entities through institutional innovation? Recently, the Ecological Environment Bureau of Songjiang District officially released the "Specific Measures to Optimize the Business Environment and Assist in the High Quality Development of Modern Songjiang with" Science and Technology Innovation, Humanity, and Ecology ", clarifying 16 tasks and measures, including unblocking the" green channel "for environmental impact assessment approval and coordinating ecological environment supervision and law enforcement, to provide a package of institutional supply in the field of ecological environment.

Ma Hongying, from the Ecological Environment Bureau of Songjiang District, stated that in order to actively serve and integrate into the new development pattern, guided by the construction of the G60 Science and Technology Innovation Corridor, and to fulfill various responsibilities with high standards, quality, and level, under the guidance of the district committee and government, the "Sixteen Measures" business strategy has been launched through theoretical research, project research, and difficult case discussions.

Play a key role in policy protection

"In this version of the 'Sixteen Articles', we have organically integrated the three main reform measures of optimizing the ecological environment management of industrial parks, improving the efficiency of project environmental impact assessment approval, and deeply integrating environmental impact assessment and pollutant discharge permit in the' Several Opinions on Supporting the Deepening of Environmental Impact Assessment and Pollutant Discharge Permit Reform in the Construction of New and New Cities' issued by the Municipal Ecological Environment Bureau last year with the regional reality. We hope to solve the problems of excessive environmental impact assessments and one size fits all planning environmental impact assessments, and also encourage similar projects to bundle environmental impact assessments for approval." said the head of the Environmental Impact Assessment Permit Department of the Songjiang District Ecological Environment Bureau.

In addition to connecting to the "antenna" and studying how higher-level policies can be implemented, it is also necessary to take on the responsibility of proactive service by connecting to the "local atmosphere". Previously, Songjiang Enterprise Zhongyin Babi submitted an environmental impact assessment application for the expansion project. Due to strong market demand, enterprises need to quickly expand production capacity and seize development opportunities. After understanding this situation, the Ecological Environment Bureau of Songjiang District took the initiative to open a "green channel" for approval and assign dedicated personnel. "As the project is located in the Songjiang Economic and Technological Development Zone and has been included in the scope of linkage implementation, and within the scope of Songjiang New City, it meets policy requirements. Therefore, some of the renovation and expansion construction projects that were originally supposed to prepare an environmental impact report can be implemented for filing management."

As a result, Zhongyin Babi became the first enterprise in Songjiang District to enjoy the five new city policies, and also the first enterprise in the city to enjoy the preferential policy of "simplified management of environmental impact assessment report forms" in the implementation of new city reform policies.

Under the patient guidance of the Environmental Impact Assessment Permit Officer, the project leader gradually completed the offline filing and change of the pollutant discharge permit. The expected publicity, approval, and acceptance are all gone! The process has been streamlined and optimized, causing the project leader to exclaim surprise.

Recently, Dow Silicone Co., Ltd. has also enjoyed the convenience brought by the "Sixteen Measures" policy. The company is a high-quality enterprise that established a factory in Songjiang in 1995 and has been deeply rooted in it for a long time. In 2022, we will implement technological upgrades in response to market demand, in accordance with relevant industrial policies and with a commitment based approval system. At the same time, the district ecological environment bureau is also exploring the transformation of environmental impact assessment approval and technical assessment from series to parallel, further compressing approval time.

On the second day after the formal approval of the project, the enterprise received the promised approval decision for the technical renovation project. The actual approval time was only one working day, truly achieving the "come and do" project approval.

It is reported that as of now, five parks including Shanghai Lingang Songjiang Science and Technology City have been included in the planning and project environmental impact assessment linkage, covering more than half of the total area of all parks. Over the past two years, there have been a total of 314 projects that have been approved through notification and commitment, accounting for 41% of the projects in reports and forms. Two more parks are expected to be included in the linkage this year. With the increase in the number of integrated parks, the proportion of projects that have been approved through notification commitments has increased sharply. This means that more and more enterprises are enjoying the convenience of immediate and rapid approval, saving time and other costs.

Provide policy support for flexible law enforcement

In Article 16, it is clear that the approval deadline for credit repair will be compressed from the statutory 5 working days to 3 working days, and a positive list system will be promoted, graded and classified supervision will be implemented, off-site supervision will be implemented, and minor penalties will be exempted.

This policy measure has given a sense of gain to many companies that unintentionally violate minor rules due to their lack of understanding of the policy. Previously, the Ecological Environment Bureau of Songjiang District imposed an administrative penalty of ordering a certain enterprise to rectify its violations within a specified period of time and imposing a fine of RMB 480000 in accordance with the law. After the expiration of the reminder period, if the enterprise still fails to fulfill the administrative penalty decision, the district ecological environment bureau shall apply to the court for compulsory enforcement in accordance with the law. During the investigation, it was learned that the company was struggling to survive due to the impact of the epidemic, resulting in a significant reduction in scale and production. It is unable to pay the fine in a lump sum and hopes to postpone or pay in installments.

"As a regulatory department, in addition to fulfilling its regulatory and law enforcement responsibilities, we should also actively assist enterprises, and law enforcement should be strong and warm," said the head of the Law Enforcement and Inspection Department of the District Ecological Environment Bureau. "Therefore, we immediately contacted the district procuratorate to share case clues and information, hoping to solve the problem for the enterprise through substantive resolution of administrative disputes."

After thorough research and discussion, considering the difficult operating conditions of the enterprise and the sincere repayment attitude, we agree that the enterprise will pay the fine in installments and reach an agreement on the specific matters of installment payment. It is worth mentioning that after coordinating with the district procuratorate and court, the Ecological Environment Bureau of Songjiang District has actively proposed to apply to the court to lift the inclusion of enterprises in the list of dishonest executed persons and restrict high consumption after the relevant enterprises fulfill their first payment obligations in a timely manner.

"The administrative department allows enterprises to pay fines in installments, which brings a win-win situation. It can not only ensure the final implementation of fines, but also fully guarantee the space for enterprise production and development." The head of the Law Enforcement and Inspection Department of the District Ecological Environment Bureau said that with the "Sixteen Articles" as a basis, law enforcement is more scientific. This practical case has also been awarded the Excellent Credit Commitment Case for National Benefiting and Convenient Enterprises in 2023, making it the only one in the city.

In addition, the District Ecological Environment Bureau has established a legal research group led by the main leaders of the bureau, gathering a group of backbone members to carry out theoretical research, project research, difficult case discussions and other law enforcement practices, providing strong legal support and guarantee for the bureau's various work.
