Several Provisions of Shanghai Municipality on Promoting the Standardization, Innovation and Development of Pudong New Area

Article 1: In order to promote the standardized innovation and development of Pudong New Area, enhance the internationalization level of standards, promote the opening up of standard systems, and lead high-quality development, this regulation is formulated in accordance with the basic principles of relevant laws and administrative regulations, combined with the actual situation of Pudong New Area.

Article 2: The standardized innovation and development of Pudong New Area should benchmark against the highest international level, combine with the actual situation and future trends of economic and social development, rely on the advantages of science and technology innovation sources and industrial agglomeration, take the lead in formulating internationally advanced standards in fields such as artificial intelligence, integrated circuits, biopharmaceuticals, civil aviation, and modern service industry, and build a standard system with a reasonable structure, prominent focus, and meeting the requirements of high-quality development.

Article 3: The Municipal People's Government shall strengthen its leadership over the standardization innovation and development work, improve the coordination mechanism for standardization work, deepen cooperation with relevant national departments, and coordinate major issues in the standardization innovation and development work of Pudong New Area.

The People's Government of Pudong New Area should establish and improve the mechanism for promoting standardized innovation and development, and promote standardized innovation and development.

Article 4: The municipal standardization administrative department is responsible for coordinating the promotion of standardization innovation and development in this city, relying on the cooperation and coordination mechanism between standardization departments and cities, and coordinating the promotion of standardization innovation and development in Pudong New Area.

The standardization administrative department in Pudong New Area is specifically responsible for promoting and implementing standardization innovation and development work within its administrative region.

The development and reform, economic informatization, commerce, education, science and technology, agriculture and rural areas, human resources and social security, local financial supervision, state-owned asset management, intellectual property and other departments of the city and Pudong New Area shall jointly promote the standardized and innovative development of Pudong New Area within their respective responsibilities.

Article 5: The standardization administrative authorities and industry authorities in science, technology, economy, commerce, agriculture and rural areas in Pudong New Area shall guide social organizations, enterprises, and research institutions to participate in the research and formulation of national standards, industry standards, local standards, and international standards, adopt advanced domestic and foreign standards, and promote the implementation and application of relevant standards in this city overseas; Encourage the introduction of foreign language versions of group standards and enterprise standards.

The People's Government of Pudong New Area shall provide services and guarantees for foreign-invested enterprises to participate equally in the formulation of standards in accordance with the law.

Article 6: The People's Government of Pudong New Area shall establish a linkage mechanism between the standardization administrative department, the science and technology economic department, and relevant industry departments, promote the integration of the industrial chain, innovation chain, supply chain, and standard chain, guide scientific research institutions, universities, enterprises, etc. to promote the synchronous layout, synchronous development, and synchronous application of standards in science and technology innovation and implementation of industrial projects, regard standards as important outputs of science and technology plans, and achieve effective connection and interaction between science and technology, standards, and industries.

Article 7 Enterprises, research institutions, higher education institutions, financial infrastructure operation institutions, or standardization technology organizations in Pudong New Area may collaborate with each other or with other enterprises or organizations at home and abroad to form a standard innovation consortium and jointly formulate joint enterprise standards. Enterprise joint standards belong to enterprise standards.

Encourage the development of enterprise joint standards that meet technical requirements higher than recommended standards and demonstrate leadership, and encourage the development of enterprise joint standards with international advanced levels.

The parties forming the standard innovation consortium can negotiate and determine the formulation, ownership, and implementation of enterprise joint standards.

Article 8: Enterprise joint standards shall be published after numbering.

The numbering of enterprise joint standards consists of enterprise standard code/joint standard code, standard innovation consortium code, sequence number, and year number. The standard innovation consortium code can be composed of Chinese pinyin letters, Arabic numerals, or both.

Enterprise joint standards can be published in the name of standard innovation consortia.

Article 9: The standards for enterprise alliances shall be voluntarily implemented by the parties forming the standard innovation consortium or voluntarily adopted by other domestic and foreign enterprises or organizations in accordance with the agreement.

Encourage all parties involved in forming standard innovation consortia to implement joint enterprise standards. Enterprises or organizations implementing joint enterprise standards shall make a self declaration and publicly disclose the number and name of the standards they implement, as well as the functional and performance indicators of their products and services. Encourage relevant enterprises or organizations to publicly declare themselves through the Enterprise Standard Information Public Service Platform.

If an enterprise or organization that implements the joint standards of enterprises produces products or provides services that do not meet the technical requirements of its self declared public standards, it shall bear civil liability in accordance with the law.

Article 10: According to the technical specifications evaluated by the "Shanghai Standards", if a joint enterprise standard is voluntarily applied for and evaluated by a third-party organization with legal conditions, and meets the leading domestic and international requirements, the "Shanghai Standards" logo can be used on the standard text.

It is prohibited to use joint standards of enterprises to set unreasonable technical trade barriers, and to use joint standards of enterprises to implement behaviors that hinder the free flow of goods and services and exclude or restrict market competition.

Article 11: The standardization administrative departments of cities and districts shall provide guidance and supervision on the formulation of joint enterprise standards, and supervise and inspect the implementation of standards.

If the technical requirements of the enterprise joint standard are lower than the relevant technical requirements of the mandatory national standard, the municipal or district standardization administrative department shall order correction within a specified period of time; If the relevant standards are not corrected within the prescribed time limit, the municipal standardization administrative department shall abolish them and make them public on the standard information public service platform.

If the joint standards of enterprises are not numbered according to these regulations, the standardization administrative department of the city or district shall order them to make corrections within a specified period of time; Those who fail to make corrections within the prescribed time limit shall have their relevant standard numbers revoked by the municipal standardization administrative department and made public on the standard information public service platform.

If an enterprise or organization that implements joint enterprise standards fails to publicly disclose the standards it implements in accordance with the law, the municipal or district standardization administrative department shall order it to make corrections within a specified period of time; Those who fail to make corrections within the prescribed time limit shall be publicly displayed on the standard information public service platform.

If the use of joint enterprise standards hinders the free flow of goods and services and restricts market competition, it shall be dealt with in accordance with the provisions of the Anti Monopoly Law of the People's Republic of China and other laws and administrative regulations.

Article 12: The People's Government of Pudong New Area may form standardized and guiding technical documents on management models with regional characteristics, focusing on urban digital transformation, basic public services, social governance, and other aspects.

The municipal standardization administrative department, in conjunction with relevant departments at the municipal level, provides guidance to the People's Government of Pudong New Area in formulating standardization guidance technical documents. Significant results and mature conditions can be promoted.

Article 13: The People's Government of Pudong New Area shall support social organizations, enterprises, and research institutions in Pudong New Area to build standard digital platforms or convert relevant standards into machine-readable and interpretable data through municipal standardized service platforms, in order to enhance the synergy and convenience of standard implementation and product quality management.

Article 14: The People's Government of Pudong New Area encourages technology, intellectual property and other trading institutions to provide registration, evaluation, matching, settlement and other services for transactions related to standards. Trading institutions shall formulate trading rules and other relevant business rules, and make them public to the public.

Article 15: Encourage financial institutions to explore standard financing and credit enhancement services in Pudong New Area, incorporate the formulation and implementation of standards into enterprise financing credit evaluation, and improve the financing amount and convenience of enterprises.

Article 16: The municipal standardization administrative department shall, in accordance with the national deployment, encourage and support social organizations, enterprises, scientific research institutions, etc. to strengthen communication and coordination with relevant international standard organizations, and deeply participate in international standardization exchanges and cooperation. Support standardization institutions in key areas such as integrated circuits, biopharmaceuticals, and artificial intelligence to settle in Pudong New Area.

The People's Government of Pudong New Area should encourage the technical committees, sub technical committees, working groups, and branches and offices of international professional standards organizations to settle in Pudong New Area and provide corresponding support.

For international conferences and other activities in the field of standards held in Pudong New Area, relevant departments of the city and Pudong New Area should provide support such as information communication and convenient personnel exchanges.

Article 17: The municipal standardization administrative department and the competent departments of industries such as economic informatization, commerce, science and technology, agriculture and rural areas shall support Pudong New Area in focusing on regional key industries and industries, cultivating relevant standardization technology organizations, and playing their organizational and management roles in international and domestic standard research, formulation, and promotion.

Article 18: Build a multi-level standardized talent system in Pudong New Area. The people's government and relevant departments of the city and Pudong New Area support Pudong New Area in cultivating international standardization talents through various forms and conducting international standardization education and training activities; Encourage researchers to improve their standardized skills and professional knowledge; Encourage educational and research institutions to establish standardized chemistry majors, or offer standardized courses in related disciplinary fields, and optimize and improve the incentive mechanism for standardized talents in vocational ability evaluation and title evaluation.

The People's Government of Pudong New Area should include international standardization experts in the support scope of district level talent policies. Provide convenient services for international standardization experts and their teams who meet the requirements, such as residence and entry/exit, work in China, settlement, and housing, and support their related innovation and entrepreneurship projects; Relying on standardization expert resources to carry out standardization work training and guidance services, and building a standardization work exchange platform.

Article 19: The special funds for standardization in Pudong New Area shall provide subsidies or rewards to units participating in the standardization, innovation and development related work in Pudong New Area in accordance with regulations.

Encourage social forces to support standardized innovation and development through the establishment of funds, donations, equity investments, and other means.

Article 20: These regulations shall come into effect on October 14, 2023.
