The third meeting of the 16th Standing Committee of the People's Congress of Shanghai, held on June 20th, voted to pass the "Several Provisions on Improving the Ecological Environment Protection System of Pudong New Area in Shanghai". This is the third Pudong New Area regulation formulated around green ecology, following the "Several Provisions on the Development of Green Finance in Pudong New Area in Shanghai" and "Several Provisions on the Resource Utilization of Solid Waste in Pudong New Area in Shanghai".
Yan Rui, Director of the Legal Work Committee of the Standing Committee of the Municipal People's Congress, stated that in accordance with the Guiding Opinions of the Leading Zone, this legislation will further focus on improving the ecological environment protection system, improving the level of legal protection of the ecological environment in Pudong New Area, and leading the construction of the city's ecological and environmental protection legal system.
The "Several Regulations" have a total of 15 articles, clarifying that Pudong New Area will include carbon peaking and carbon neutrality in the overall economic and social development, establish and improve incentive and constraint mechanisms for reducing pollution emissions and greenhouse gas emissions, and promote the comprehensive green transformation of economic and social development.
In order to further improve the prevention system of ecological environment protection at the source, the following institutional mechanisms have been innovatively proposed, including: promoting the collaborative compilation of atmospheric pollutant source emission lists and greenhouse gas emission lists; Improve the carbon emission management system and include carbon emissions in the scope of environmental impact assessment; Optimize the mechanism for handling environmental impact assessments, innovate the synchronous processing of environmental impact assessments and pollutant discharge permits, etc.
In order to improve the process control system for ecological environment protection, the "Several Regulations" innovatively propose to explore and promote standardized management of farmland water return, and strengthen the prevention and control of agricultural non-point source pollution; Promote the establishment of a control mechanism for new pollutants such as persistent organic pollutants, and strengthen the control and governance of the entire process for new pollutants; Further strengthen the environmental responsibility of enterprises and strengthen the management of environmental information disclosure.
In order to further improve the system of ecological environment damage compensation, this legislation further clarifies the division of responsibilities between street towns and various competent departments in the work of ecological environment damage compensation; Clearly, environmental public welfare organizations registered in accordance with the law can be invited to participate in ecological and environmental damage compensation work as third parties for consultation; Explore electronic assessment methods for ecological environment damage identification, establish an ecological environment public welfare fund system, and explore alternative restoration methods such as carbon sink subscription; Exploratory regulations are made for on-site sampling, off-site technical monitoring, etc. The Several Regulations also strengthen the relevant safeguard measures for ecological environment law enforcement, and increase the punishment for issues of widespread concern in the field of ecological environment; Improve the punishment standards for falsifying environmental data and further impose stricter penalties.
