This is one of the application scenarios of the newly launched "Shanghai Court Trial Supervision and Management Platform", and it is also an important achievement of the Shanghai Higher People's Court's theme education and investigation research this year - a trial supervision and management platform that uses data filtering, comparison, collision, real-time warning of regulatory loopholes, intelligent evaluation of case quality, and system prevention of errors and defects.
"Unlike grassroots courts, the Supreme Court directly hears relatively few cases. How to do a good job in legal unity, case guidance, supervision and management, and achieve the effect of 'trial one case, governance one area', is a heavier responsibility related to the overall trial, and is also the fervent expectation of the people." The relevant person in charge of the Shanghai High Court introduced that since the launch of the theme education, the High Court has determined the research direction, highlighted problem orientation, identified 26 grassroots contact points around 11 topics, conducted 51 investigations, covering 16 districts in the city, and conducted 13 dissected investigations of typical cases.
In the survey, many grassroots courts have reported that in recent years, Shanghai courts have achieved certain results in promoting digital construction. However, the problems of each court's own research and application are more prominent, and they have not formed sufficient synergy. Some parties have also expressed dissatisfaction with this.
This caught the attention of the Shanghai High Court. The research team believes that adhering to digital empowerment and introducing big data analysis methods into case quality evaluation is of great significance for achieving fairness and efficiency. However, in order to truly play its role, it is necessary to break down data barriers and achieve "one court breakthrough, city sharing".
The Shanghai Court Trial Supervision and Management Platform has emerged as a result. After several months of preparation, the platform has deconstructed over 3 million judgment documents from Shanghai courts in the past 5 years, created supervision models, and modeled 132 application scenarios, achieving initial results. For example, in order to improve the implementation rate, a digital model for "property inspection and control supervision of the final execution case" was constructed. Starting from the query and analysis of "provident fund account balance", data was connected with the Municipal Provident Fund Management Center, and analysis and comparison were carried out based on the big data of the Shanghai Court's execution process management system. If funds were found in the defendant's provident fund account and met relevant conditions, supervision instructions were automatically issued. At present, 1156 sample cases that meet the conditions for resuming execution have been successfully obtained.
To enrich the application scenarios of the platform, the Shanghai High Court has changed its previous development model and instead encouraged all courts in the city to actively apply, allowing users to participate in the platform development process, achieving a transformation from case handling to case evaluation, and then to system governance. For example, in the modeling of the application scenario of "Identification and Supervision of Professional Lenders", the Minhang District People's Court of Shanghai deeply excavated the data information of private lending cases in the city's courts in the past two years, and summarized a list of suspected professional lenders based on the "portrait" of professional lenders, providing support for the functional exploration of this application scenario.
As of now, courts at all levels in the city have applied for 877 application scenarios, 132 application scenarios have achieved initial results, and 45 application scenarios have been promoted in courts throughout the city. These application scenarios have driven a significant improvement in the quality of a large number of cases. In the first half of this year, Shanghai's courts ranked among the top in terms of indicators reflecting trial quality, efficiency, and effectiveness, such as the rate of remanding new judgments, case ratio, average closing time, and the rate of serving judgments and resolving lawsuits. At the recent National Judicial Seminar, the work performance of Shanghai courts in the first half of the year was fully recognized.
