With only two days left to announce the cancellation of the performance, whose fault is it?

On July 18th, singers Ai Yiliang and Sun Shengxi jointly announced that they would hold joint performances on August 10th and August 12th at LiveHouse in Guangzhou and Shenzhen, respectively. However, two days before the performance, the artist and the organizer, Capsule Entertainment, suddenly announced the cancellation of the performance.

Ai Yiliang and Sun Shengxi posted on Weibo stating that due to the organizer's failure to fully fulfill the relevant rights and obligations of the contract before the departure of the team, after coordination, our company stands in the position of protecting the rights and interests of artists and the team's performance, and cancels the plan to attend the performance as scheduled.

The ticket prices are divided into three levels: early bird ticket 290 yuan, regular ticket 340 yuan, and VIP ticket 380 yuan. According to the news released by the organizer "Capsule Entertainment" that "tickets will be sold out in seconds and will not be added in the future", it can be inferred that the total box office revenue of the two sold out performances is estimated to exceed 700000 yuan.

It is worth noting that the organizer "Capsule Entertainment" mentioned in the cancellation statement of the performance that the ticket money will be refunded in the original way and will provide some compensation to everyone when the performance starts again. This incident is not an exception. In the past month, "Capsule Entertainment" has cancelled or postponed four performances in a row, such as the joint performance of Shengxiang Band and Wangwen originally scheduled for July 27th, which has also been postponed due to "difficulties encountered by some of Shengxiang Band's musicians in entering the country for endorsement.".

According to incomplete statistics, in July and August 2023 alone, at least 15 performance events in the music and entertainment market were announced to be postponed or cancelled after official announcement, such as the Qinghai Sailing Music Festival, the 2023 Rose Music Festival in Jilin City, China, and the Mao Buyi "Young Bird Guide" Tour Beijing Station. Regarding this issue, lawyer Zuo Cuicui from Beijing Qinglu Law Firm told reporters that according to Article 136 (2) and Article 566 of the Civil Code of the People's Republic of China, if the organizer does have a breach of contract, the parties have the right to request compensation for losses.

"Consumers can first contact the organizers or ticketing websites to learn about ticket refund policies and procedures, provide relevant evidence, purchase vouchers, etc., and request the organizers to refund the ticket price, compensate for accommodation and transportation costs, or provide other reasonable solutions. In the event of unsuccessful communication, they can file a complaint, report, or file a lawsuit with relevant departments such as the Consumer Association, Market Supervision Administration, and Cultural Tourism Bureau."

However, Zuo Cuicui frankly stated that overall, it is difficult for consumers to protect their rights, which is influenced by various factors such as the policies of the organizers, refund policies on ticketing websites, purchasing insurance, special policies, and public opinion. Previously, the temporary cancellation of a concert by an artist caused dissatisfaction among fans, and ultimately ended with the studio fully compensating for transportation and accommodation losses, but such situations are not common.

"Before purchasing tickets, consumers should carefully read the ticket website or the organizer's refund policy and purchase contract to understand their rights and responsibilities. Tickets purchased through unofficial channels such as' scalpers' may ultimately fail to fulfill their rights protection requests. Therefore, it is recommended to purchase tickets through official channels and keep specific order records and other evidence." Finally, Zuo Cuicui proposed a compromise suggestion: "Domestic insurance companies have types of insurance for consumers, such as performance cancellation and delay insurance, which can share the economic losses caused by temporary cancellation of performance activities. Consumers can choose to purchase them."
