The notice points out that in the regulations for the National Day and Memorial Day holiday announced by this court on December 23, 1949, August 15 was designated as the Victory Day of the Anti Japanese War. Japan's surrender was implemented after the Japanese government signed the surrender treaty on September 2, 1945. Therefore, the Victory Day of the Anti Japanese War should be rescheduled to September 3rd.

This determination was once again confirmed in 1999. On September 18, 1999, the State Council revised the regulations for national holidays and commemorative days, and still designated September 3 as the Victory Day of the Anti Japanese War.
Regarding this, Professor Chen Xianxian from the School of Marxism at Renmin University of China once explained that the Victory Memorial Day of the Chinese People's War of Resistance Against Japanese Aggression cannot be scheduled on August 15th for two reasons. The first reason is that on the battlefield in China, there were still wars on and after August 15th, but in reality, they did not stop. Whether it was on the front or behind enemy lines, there were still wars going on; Secondly, the Japanese Imperial Edict on the Termination of War was in the form of an edict and had no international legal basis.
On February 27, 2014, the 7th meeting of the 12th National People's Congress Standing Committee passed a resolution for the first time in the form of national legislation, designating September 3 as the "Victory Day of the Chinese People's War of Resistance Against Japanese Aggression". Earlier, Li Shishi, Director of the Legal Work Committee of the Standing Committee of the National People's Congress, emphasized in his explanation of the draft decision of the Standing Committee of the National People's Congress on determining the Victory Memorial Day of the Chinese People's War of Resistance Against Japanese Aggression that the draft continues the provisions of the State Council and the State Council on the Victory Memorial Day of the Chinese People's War of Resistance Against Japanese Aggression, and designates September 3rd as the Victory Memorial Day of the Chinese People's War of Resistance Against Japanese Aggression.
