We must make them pay the legal price, and their crimes should be punished! Media: Those who incite others to commit suicide can be punished. Instigating | Helping | Reporting | Platform | Showing off | Death | Case | Suicide
On August 8, a case report published on the WeChat official account of the Justice Network of the Procuratorial Daily, "Help others to show off on the Internet after committing suicide, sentenced!" attracted the attention of many social media. According to the report, Feng from Chengdu, Sichuan once posted a large number of comments on suicide and depression online, including "Suicide Together" and "Painless Death Methods". He also joined multiple WeChat groups to recommend suicide methods to multiple netizens. Ma, a student suffering from depression in Jinan, Shandong, believed Feng's words and committed suicide under his guidance.
Although Feng was finally sentenced to five years for intentional homicide, which ended this intentional homicide committed by using the Internet, such "death appointment" events should arouse our great attention.
On April 7, 2023, Zhangjiajie, Hunan Province reported that four people from other provinces jumped off a cliff in Tianmen Mountain. Three men died while jumping, and a woman died before jumping due to taking poison and emergency medical treatment. On April 24th, Shifang, Sichuan reported that three people had taken poison and committed suicide at a forest farm in Yinghua Town from other places. Less than 20 days apart, 7 people successfully "agreed to die". Indeed, according to the police report, several individuals committed suicide, which is different from the case mentioned earlier. But what we need to note is that there may be people like Feng lurking in the various channels through which they "agreed to die".
It was mentioned in the article "Help others in the air show off on the Internet after committing suicide, sentenced!" that after Ma committed suicide, Feng repeatedly asked "Brother, have you left?" through WeChat, and boasted to other netizens on the Internet, "I just sent it away", which made people shudder. Who is he showing off to? Is it a "kind-hearted person" who "helps others commit suicide" like him, or is it a search for the dead like Ma? Will anyone be tempted to see his "success stories" and cause more lives to fall? To eliminate this possibility, we may start from the following points:
Firstly, for those who incite others to commit suicide, they must bear the legal cost. In the above-mentioned case, the judicial authorities accurately determined the following three issues:
▄ First, whether the suspect's behavior is abetting, inducing or helping in the traditional sense;
▄ Second, whether there is a causal relationship between the suspect's behavior and the death result of the deceased in criminal law;
The third is the evaluation of criminal liability for committing suicide by mutual agreement.
After comprehensive consideration, it is determined that Feng's behavior meets the constituent elements of intentional homicide. According to Article 232 of the Criminal Law of the People's Republic of China, intentional homicide shall be sentenced to death, life imprisonment, or fixed-term imprisonment of not less than ten years; Those with minor circumstances shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years. The author believes that the trial of this case may serve as an important reference for handling such cases.
Secondly, platforms with instant messaging capabilities should have keyword warning mechanisms and reward mechanisms for reporting. With the development and improvement of big data technology, whether it is information retrieval, screening, supply, or feedback, it is more accurate. We hope that relevant technologies can play a greater role in important and critical times. At the same time, the platform can also set up a reward mechanism for reporting urgent matters. If an individual can timely report the "persuasion of the deceased" lurking in various groups and successfully prevent the tragedy from happening, and the platform verifies its authenticity, a certain reward can be given.
Thirdly, if you find someone around you who has been emotionally negative for a long time, you should promptly guide or guide them to seek professional help. According to the 2022 National Depression Blue Book, there are currently 95 million people suffering from depression in China, with approximately 280000 people committing suicide each year, of which 40% suffer from depression. This set of numbers is so shocking, and what each of us can do is to try to maintain our physical and mental health as much as possible, while caring more about the people around us and encouraging those in need to actively seek positive help.
Finally, the author would like to say that choosing to end life with "death" is not considered a crime. Those who use the pain of others to incite their death are the ones whose hearts are to be punished and their sins should be punished.
On the day of the publication of the report "Assisting Others with Suicide Across the Space, Still Showing Off Online, Judgment!", which coincided with the beginning of autumn, some people can no longer see the golden autumn due to the presence of "Feng". Shouldn't we do something about it?
