On June 12th, the company staff confirmed to the reporter that the above notice was true. The original intention of the company is to advocate for harmonious and stable family relationships among employees, in order to avoid situations that may affect work. "Only with harmonious family relationships can stable work be achieved." The employee stated that currently, no employee has violated this requirement.
The reporter contacted the Supervision Brigade of the Yueqing Municipal Human Resources and Social Security Bureau and the local squadron of the enterprise, and the staff stated that they have not received any complaints regarding this regulation at present.
Lawyer Chen Dong, a partner of Wanshang Tianqin Law Firm, analyzed that the Labor Contract Law clearly stipulates the circumstances for terminating labor contracts. China protects the legitimate rights of workers in accordance with the law, and usually only when workers are unable to work or have mismatched labor abilities can labor contracts be legally terminated. Even if the employer records extramarital affairs, infidelity, etc. in the employee handbook, it cannot be used as a legal basis for terminating the labor contract. If the employee is dismissed due to this reason, they can protect their rights in accordance with the law. Lawyer Chen Dong said, "We encourage employers to advocate for employees to establish correct values, but we cannot use this as an excuse to infringe on the legitimate rights and interests of workers."
