On the morning of June 28th, the Guangdong Provincial High Court made a final judgment on the Guangzhou Tianhe "1.11" BMW collision case, rejecting the defendant Wen Qingyun's appeal and upholding the original death penalty verdict.
A person who has watched the second trial of this case revealed to Pengpai News that during the trial, Wen Qingyun changed some of his wording when questioned, stating that he was "unconscious" and "had no sensation" before the collision. Wen Qingyun also claimed that he felt the rear trunk of the vehicle was "not clean" and wanted to drive away the "unclean" things. Meanwhile, Wen Qingyun's defense claimed that a few days before the incident, he had already been "abnormal", feeling that the car was not clean and that "there was a mysterious force following him.". Upon hearing this statement, many bystanders and the families of the injured were very angry and thought it was "nonsense". One of the injured couldn't bear it and threw his shoes over.
Pengpai News has noticed that testimonies from several relatives of Wen Qingyun indicate that his family has no history of mental illness, and Wen Qingyun's mental state is normal without any experience of going to the hospital for mental illness examination. Before the incident, Wen Qingyun had no abnormal behavior. In the previous first instance, Wen Qingyun's defense counsel proposed that Wen Qingyun was mentally abnormal and required a judicial psychiatric assessment, but this defense opinion was not adopted by the court.
The above-mentioned observer revealed that during the second trial, Wen Qingyun's defense once again requested a mental appraisal, which was rejected by the court.
The Guangzhou Intermediate People's Court determined in the first instance that on January 11, 2023, at around 17:00, Wen Qingyun intentionally drove into pedestrians and road facilities in Tianhe District, Guangzhou to vent his personal emotions, causing serious consequences such as multiple casualties and property damage. Wen Qingyun was sentenced to death and deprived of political rights for life. After the verdict was pronounced, Wen Qingyun appealed.
The defense and defense opinions of Wen Qingyun and his lawyer during the second trial were not adopted. The Guangdong Provincial High Court stated that the facts found during the trial are consistent with those in the first instance. The court believes that Wen Qingyun's criminal methods are extremely cruel, with extremely serious consequences, subjective malice, and great social harm, and should be severely punished according to law. The original judgment confirms the facts clearly, the evidence is true and sufficient, the conviction is accurate, the sentencing is appropriate, and the trial procedure is legal. After evaluation by the Economic and Social Council and discussion by the Trial Committee, the appeal was rejected and the original verdict was upheld. The death penalty ruling against Wen Qingyun shall be submitted to the Supreme People's Court for approval in accordance with the law.
The above observers stated that after hearing the second trial verdict, Wen Qingyun said "it's too heavy.".
According to a previous report by Pengpai News, on January 11, 2023, around 17:00, a BMW X3 collided multiple times with pedestrians, vehicles, and other vehicles near Tianhe Road and Tiyu East Road in Tianhe District, Guangzhou. Multiple on-site videos show that many people were injured and fell to the ground on the road, and the driver who caused the accident was throwing money after parking and attempting to escape. This case has attracted widespread attention from the outside world.
The driver of the accident, Wen Qingyun, was born in April 2000 with junior college education. His registered residence is Jiexi County, Guangdong Province, and he lives in Qishi Town, Dongguan City. Wen Qingyun grew up in Dongguan since childhood. Before the incident, his parents ran a store in Dongguan.
Why did the young Wen Qingyun hit someone while driving?
Wen Qingyun confessed that about a year ago, he successively published the use of brand-name bags, luxury cars and other content on Tiktok, and called himself a "rich second generation" pursuing the opposite sex. Shortly thereafter, an online blogger posted multiple videos exposing his false identity as a "wealthy second-generation", causing him to lose face and feel like his life had fallen into a low point. On January 11, 2023, he decided to completely let go of the past and develop in a city with a better environment. Before traveling, he went to the supermarket and overdrawn two Chinese brand cigarettes with "Huabei" to give to his grandfather. However, his parents scolded him for spending money recklessly, so he took 6000 yuan of private money and drove his father's BMW X3 to Guangzhou Baiyun Airport. After arriving at the airport, due to the lack of parking spaces in the parking lot and nearby hotels, he changed his route to Tianhe District in Guangzhou. During this time, he had a dispute with toll station staff and smashed the front windshield of a BMW car.
Wen Qingyun said that when driving to the intersection of Tiyu East Road in Tianhe District, he saw many passersby crossing the pedestrian crossing. Suddenly, he had a desire to release his inner depression, so he accelerated and continued to rush towards the crowd.
The first instance verdict revealed that the incident resulted in a total of 6 deaths, of which 5 died on the spot and 1 person died on January 19th after unsuccessful rescue efforts; More than 20 people were also injured to varying degrees.
According to the families of multiple victims, the six victims come from different families, including one delivery boy and one child. The two are married and have children, and both have a partner but not yet married.
