Recently, the Ministry of Justice and the National Cyberspace Administration conducted a special study and review of the "Regulations on the Protection of Minors on the Internet", accelerating the legislative process of the regulations.
In recent years, in accordance with the deployment requirements of the Central Committee of the Communist Party of China and the State Council, relevant departments have actively carried out network protection work for minors, issued a series of policy documents such as the "Opinions on Strengthening the Construction of Network Civilization", and created a special chapter on "Network Protection" in the revision of the Law on the Protection of Minors. The formulation of the Regulations on the Protection of Minors on the Internet has been included in the legislative work plan of the State Council.
The draft provides provisions for strengthening the promotion of minors' internet literacy, standardizing internet information content, protecting personal information networks of minors, and preventing and controlling internet addiction among minors. It also stipulates corresponding legal responsibilities for relevant illegal acts. The draft focuses on the prominent problems faced by minors in online protection work, summarizes the practical experience of minors in online protection work in recent years, elevates mature practices into regulatory systems, and improves the comprehensive network governance system.
According to statistics, in 2021, the number of minor Internet users in China will reach 191 million, and the Internet penetration rate of minors will reach 96.8%. While expanding minors' learning and living space, the Internet has also brought some problems, such as minors' lack of awareness and ability to use the Internet safely and reasonably, online violations and bad information affect minors' physical and mental health, minors' personal information is abused, and some minors are addicted to the Internet. It is urgent to improve legislation, further strengthen the responsibility of the state, society, schools, families and other subjects for minors' network protection, standardize the management of network information content, protect minors' personal information, respond to the concerns of the people, and create a network environment conducive to the healthy growth of minors.
The Ministry of Justice and the National Cyberspace Administration have done a lot of meticulous work in the process of drafting and reviewing the draft, repeatedly soliciting opinions from the public, widely soliciting opinions from relevant central units, some local governments, relevant enterprises, industry associations, and experts, and consolidating social consensus; Through repeated research and argumentation, the draft has been revised and improved multiple times, ensuring the legitimate rights and interests of minors at the legislative level and creating a clean and upright online space.
