Today, the Guangdong Higher People's Court, in accordance with the law, pronounced judgments in the second instance of the case of 47 people, including Huang Yongcun and Huang Yongyu, who organized, led and participated in criminal organization, and ruled to reject the appeal, uphold the original sentence, and report the death sentences of Huang Yongcun, Huang Yongyu and Zhong Yaguang to the Supreme People's Court for approval.
Previously, Zhanjiang Intermediate People's Court sentenced the defendants Huang Yongcun and Huang Yongyu to death in the first instance for the crimes of organizing and leading a criminal organization, intentional homicide, intentional injury, obstruction of official duties, intentional destruction of property, opening a casino, provocation and trouble making, forced trading, extortion, collection of illegal debts, affray, illegal detention, etc; Zhong Yaguang, the defendant, was sentenced to death for the crime of participating in a criminal organization, the crime of intentional homicide, and the crime of provocation and trouble making. The remaining 44 defendants were sentenced to death with a suspended sentence of 1 year and 2 months, and each defendant was sentenced to property penalties in accordance with the law. After the verdict was pronounced, some defendants appealed.
The court found that in the 1980s and 1990s, Huang Yongcun and his younger brother Huang Yongyu gathered multiple people to set up casinos and engage in fights in multiple places in Lianjiang City. In 1999 and 2002, Huang Yongcun and Huang Yongyu ordered Zhong Yaguang and others to shoot others in order to seize territory, resulting in the death of two people. From then on, Huang Yongcun and Huang Yongyu's gang gained widespread notoriety. On the one hand, they continuously expanded their sphere of influence through illegal activities such as intentional injury, opening casinos, forced transactions, extortion, group fights, and provocation; On the other hand, illegal means have been used to monopolize industries such as scrap iron, scrap rubber purchase and cement clinker transportation market, seizing huge illegal interests, and a large number of criminal organization have gradually formed, with Huang Yongcun and Huang Yongyu as organizers and leaders, Zhong Yaguang and others as backbone members. The organization has committed 37 illegal and criminal acts, including intentional homicide, intentional injury, obstruction of official duties, intentional destruction of property, extortion, crowd fighting, illegal detention, opening of casinos, provocation, forced transactions, and collection of illegal debts, resulting in 2 deaths, 39 injuries, oppression, and harm to the public, seriously disrupting the local economic and social order, and causing extremely negative impacts.
The second instance court believes that the facts determined in the first instance judgment are clear, the evidence is true and sufficient, the law and conviction are accurate, the sentencing is appropriate, and the trial procedure is legal. Therefore, the above ruling is made in accordance with the law.
More than 80 relatives of the appellant, victims, and people from all walks of life attended the verdict.
