The Emergency Management Department has released 6 typical cases of safety production reports
In conjunction with the national special investigation and rectification of major accident hazards in 2023, various regions will further promote the reporting of safety production, encourage the public to participate in supervision, identify major accident hazards, and crack down on illegal activities related to safety production. Recently, the Emergency Management Department has selected and published 6 typical cases of safety production reports from the serious investigation and handling of reported cases in various regions.
Case 1: Reporting production and operation units concealing production safety accidents
In May 2023, the Emergency Management Department of Henan Province received a phone call from the public reporting a collapse accident at a metal mining company in Miyang County, Zhumadian City, resulting in four deaths. According to relevant procedures, the Emergency Management Department of Henan Province and the People's Government of Zhumadian City immediately organized inspections. After investigation, on May 4, 2023, a roof collapse accident occurred underground in the mining company, resulting in four deaths. After the accident, the company did not report to relevant units and departments, and there was a concealment behavior. The accident is still under investigation.
The whistleblower promptly discovered and reported the concealment of accidents by production and operation units. In accordance with Article 6 of the Implementation Measures for Reporting Rewards in the Field of Safety Production in Henan Province, the Emergency Management Bureau of Zhumadian City rewarded the whistleblower with RMB 160000 in June 2023.
Case 2: Reporting special operation personnel from production and operation units who are not certified to work
In May 2023, the Emergency Management Bureau of Shengzhou City, Zhejiang Province received a report from the 12345 government hotline, reporting that a certain metal product company in Sanjie Town, Shengzhou City had unlicensed welders and had not received training, which posed a safety hazard. According to relevant procedures, the Emergency Management Bureau of Shengzhou City will verify the reported content. After investigation, it was found that a certain electrical factory and the company were operating in the same location, and one operator of the electrical factory did not hold a special operation certificate for welding operations. The above behavior violates Article 30, Paragraph 1 of the Safety Production Law of the People's Republic of China. In accordance with Article 97, Paragraph 7 of the Safety Production Law of the People's Republic of China, the Emergency Management Bureau of Shengzhou City ordered relevant personnel to stop operations and imposed a fine of RMB 12000 on the electrical factory.
If a whistleblower discovers and reports illegal activities related to safety production in production and operation units, the Shengzhou Emergency Management Bureau will reward the whistleblower with RMB 3000 in June 2023 in accordance with Article 16 (1), Article 17, and Article 18 of the Implementation Rules for Reporting Rewards for Major Safety Production Hazards and Illegal Activities in Shengzhou City.
Case 3: Reporting hidden dangers and illegal activities of production and operation units
In April 2023, the Emergency Management Department of Sichuan Province received online reports from the public that a hazardous chemical production enterprise in Nanxi District, Yibin City had engaged in multiple safety production violations, including illegal storage of hazardous chemicals and inability to use the emergency shutdown system in the liquid ammonia tank area. According to relevant procedures, the Emergency Management Department of Sichuan Province will verify the reported content. After investigation, it was found that the enterprise engaged in illegal storage of hazardous chemicals such as sodium hydroxide, resorcinol, ammonia, etc., did not include the liquid ammonia backup tank in the maximum design quantity calculation, and had no power supply for the pneumatic valve in the third level major hazard source tank area. The above behavior violates Article 36, Paragraph 2 of the Work Safety Law of the People's Republic of China, Article 24 of the Regulations on the Safety Management of Hazardous Chemicals, and Article 7 of the Interim Provisions on the Supervision and Administration of Major Hazardous Sources of Hazardous Chemicals. In accordance with Article 99 of the Work Safety Law of the People's Republic of China, Article 80 of the Regulations on the Safety Management of Hazardous Chemicals, and Article 34 of the Interim Provisions on the Supervision and Administration of Major Hazardous Sources of Hazardous Chemicals, the Emergency Management Bureau of Yibin City has issued a warning and fined RMB 101000 to the enterprise.
The whistleblower discovered and reported illegal safety production activities of production and operation units. In accordance with Article 9 (2) of the Sichuan Province Safety Production Reporting Reward Measures, the Sichuan Provincial Emergency Management Department rewarded the whistleblower with RMB 15000 in July 2023.
Case 4: Reporting Safety Production Violations by Production and Business Units
In March 2023, the Emergency Management Bureau of Wuzhong City, Ningxia Hui Autonomous Region, received a phone call from the public reporting 10 safety hazards in a petrochemical enterprise. According to relevant procedures, the Emergency Management Bureau of Wuzhong City will verify the reported content. After investigation, it was found that the company had issues such as employees wearing safety protective equipment that did not meet national standards, failure to truthfully record safety production education and training, failure to provide training to new employees on major hazards, failure to perform static electricity bridging on multiple flanges in the hydrogenation workshop, and expired calibration of combustible gas probes. The above behavior violates the provisions of Article 28, Paragraph 4, Article 36, Paragraph 2, Article 41, Paragraph 2, and Article 45 of the Work Safety Law of the People's Republic of China. The Emergency Management Bureau of Wuzhong City, in accordance with Article 97, Paragraph 4, Article 99, Items 3, 5, and Article 102 of the Work Safety Law of the People's Republic of China, orders the enterprise to make corrections within a specified period of time and imposes a fine of RMB 160000.

In accordance with Article 14 (2) of the Implementation Measures for Reporting Rewards in the Field of Safety Production in Wuzhong City, the Emergency Management Bureau of Wuzhong City rewarded the whistleblower with RMB 24000 in June 2023.
Case 5: Reporting production and operation units for illegal production of fireworks and firecrackers
In February 2023, the Emergency Management Department of Hunan Province received a phone report from the public, reporting that a fireworks manufacturing enterprise in Liling City had engaged in illegal activities of privately changing its bright pearl production line into a flute sound production line. According to relevant procedures, the Emergency Management Bureau of Liling City will verify the reported content. After investigation, the enterprise has 3 assembly and loading workshops with a limited capacity of 2 people. In fact, there are 4 people engaged in organizing and loading operations on site. There are 3 pharmaceutical column workshops, and a workbench is set up inside and outside the actual site workshop for whistle making operations. There is 1 granulation workshop for granulation screening operations, and 2 medicine cake transfer workshops for storing 9 packages and 13 packages of bright pearls, respectively. The above behavior violates Article 11 of the Regulations on the Safety Management of Fireworks and Firecrackers. In accordance with Article 37 (1) and (2) of the Regulations on the Safety Management of Fireworks and Firecrackers, the Emergency Management Bureau of Liling City ordered the enterprise to make corrections within a specified period of time and imposed a fine of RMB 80000.
According to Article 8, Item 2 of the Implementation Measures for Rewarded Reporting in the Field of Safety Production in Hunan Province, the Emergency Management Department of Hunan Province will reward the informant with RMB 12000 in June 2023 for discovering and reporting illegal safety production activities of production and operation units.
Case 6: Reporting production and operation units for illegally storing hazardous chemicals
In February 2023, the Emergency Management Bureau of Yuzhong District, Chongqing received a call from the public reporting that there were dozens of tons of methanol fuel stored in a rolling shutter door warehouse in Yuzhong District. According to relevant procedures, the Emergency Management Bureau of Yuzhong District will verify the reported content. After investigation, a new energy enterprise stored 4 tons of hazardous chemicals at the site but did not store them in a dedicated warehouse as required. The above behavior violates Article 24, Paragraph 1 of the Regulations on the Safety Management of Hazardous Chemicals. In accordance with Article 80, Paragraph 1, Item 4 of the Regulations on the Safety Management of Hazardous Chemicals, the Emergency Management Bureau of Yuzhong District has imposed a fine of RMB 50000 on the enterprise in accordance with the Administrative Penalty Discretionary Standards for Work Safety and the Administrative Penalty Discretionary Measures for Standardizing Administrative Penalties in Chongqing.
The whistleblower discovered and reported illegal and irregular safety production behaviors of production and operation units. In accordance with Article 5, Paragraph 1 of the Chongqing Safety Production Reporting and Rewarding Measures, the Yuzhong District Emergency Management Bureau awarded the whistleblower a reward of RMB 7500 in June 2023.
The Emergency Management Department will further improve the safety production reporting system, fully leverage the role of reporting work, and create a good atmosphere for everyone to participate in safety production supervision in the whole society.
