Recently, the General Office of the Central Committee of the Communist Party of China and the General Office of the State Council issued the "Opinions on Establishing a List System of Party Regulations and National Laws that Leading Cadres should Know and Know", and issued a notice requiring all regions and departments to conscientiously implement it based on actual situations.

In order to deeply implement the spirit of the 20th National Congress of the Communist Party of China, promote leading cadres to take the lead in respecting rules, learning, abiding by rules, and using rules, and take the lead in respecting law, abiding by laws, and using the law, in accordance with the requirements of the "Plan for the Construction of a Rule of Law in China" and other regulations, the following opinions are proposed on establishing a system for leading cadres to know and understand party regulations and national legal lists.

Firmly establish awareness of the Party Constitution, more consciously study Party regulations, and use the Party Constitution, Party rules, and Party discipline to constrain one's words and actions; We must firmly establish the basic concept of the rule of law, such as the supremacy of the Constitution and the law, equality before the law, the right to be determined by law, and the exercise of power in accordance with the law, and strive to think, make decisions, and handle matters under the rule of law.

1. Study the Party Constitution seriously. Making learning the Party Constitution a compulsory course and basic skill, and deeply understanding that the Party Constitution is the fundamental law of the Party, it is the fundamental behavioral norm that the entire Party must abide by. Standardize one's words and actions with the Party Constitution, act in accordance with the requirements of the Party Constitution, and always maintain a high degree of consistency with the Party Central Committee in terms of political stance, political direction, political principles, and political path. Whatever the Party Constitution stipulates that Party members must do, leading cadres must first do it; Where the Party Constitution stipulates that Party members cannot do anything, leading cadres should take the lead in not doing it.
2. Seriously study the Party's organizational regulations. According to the work needs, we should study the work regulations of the Central Committee of the CPC, the work regulations of local committees, the work regulations of discipline inspection committees, the work regulations of the Party leading groups, the work regulations of working organs, the work regulations of organizations, the work regulations of branches, the work regulations of the selection and appointment of party and government leading cadres, the provisions of promoting the ability of leading cadres to go up and down, and be familiar with the Party's organizational structure, organizational system, and the setting, positioning, production, operation, functions and duties of various organizations at all levels.
3. Seriously study the Party's leadership regulations. According to the work needs, we will study the CPC's rural work regulations, the united front work regulations, the political consultation work regulations, the political and legal work regulations, the institutional establishment work regulations, the propaganda work regulations, the CPC's national security work regulations, the letter and visit work regulations, and the local party and government leading cadres' responsibility system for work safety, deeply understand the rich connotation of adhering to and strengthening the comprehensive leadership of the party, and enhance the consciousness and determination to achieve the "two safeguards".
4. Seriously study the laws and regulations of the Party's self construction. According to the needs of work, we should study in depth several principles of inner party political life in the new situation, the CPC's code of integrity and self-discipline, the regulations on requesting instructions and reporting on major issues, the regulations on strict economy and anti waste by party and government organs, the eight central regulations and their implementation rules, the provisions on the Party committee's implementation of the overall responsibility of strictly governing the main body of the Party, and the learning rules of the theoretical learning center group of the Party committee. We should deeply understand the significance of promoting the new great project of building the Party in the new era, always maintain the tenacity and perseverance on the road, and enhance the political determination to firmly and comprehensively govern the Party.
5. Seriously study the Party's supervision and protection regulations. According to the needs of work, we should thoroughly study the CPC's inner-party supervision regulations, patrol work regulations, party and government leading cadre assessment regulations, accountability regulations, disciplinary punishment regulations, party member rights protection regulations, organizational handling regulations, inner-party law enforcement responsibility system regulations, discipline inspection organ supervision and discipline enforcement work rules, resolutely implement the party's self revolutionary strategic deployment, and constantly strengthen the party's awareness, discipline awareness, and discipline awareness.

According to work needs, learn the Law on Guarding State Secrets, Cybersecurity Law, Biosecurity Law, Emergency Response Law, Anti Terrorism Law, Anti Espionage Law, Data Security Law, etc., coordinate development and security, improve the ability of leading cadres to use legal weapons to prevent and resolve major risks, and enhance their ability to fight in accordance with the law.
3. Seriously study and promote relevant laws for high-quality development. According to work needs, study laws such as the Circular Economy Promotion Law, Rural Revitalization Promotion Law, Budget Law, Science and Technology Progress Law, Small and Medium sized Enterprise Promotion Law, Foreign Investment Law, Copyright Law, etc., learn and build a modern industrial system, optimize the business environment, comprehensively promote rural revitalization, promote high-level opening up to the outside world, implement the strategy of revitalizing the country through science and education, and promote green development, and enhance the ability of leaders to promote high-quality development.
4. Study the Civil Code seriously. Deeply grasp the basic principles of civil activities such as equality, voluntariness, fairness, integrity, public order and good customs, and green, and adhere to the basic requirements of subject equality, protection of property rights, facilitation of transactions and circulation, maintenance of personal dignity, promotion of family harmony, and accountability for infringement. Taking the Civil Code as an important benchmark for decision-making, management, and supervision, improving the ability and level of using the Civil Code to safeguard people's rights, resolve conflicts and disputes, and promote social harmony and stability. 5. Seriously study the Criminal Law and the Administrative Punishment Law for Public Officials. Deeply grasp the basic principles of criminal law, such as the legality of crimes and punishments, equality in the application of law to anyone who commits a crime, and compatibility between crime, responsibility, and punishment, and promote the lawful crackdown on crime and the protection of human rights. Learn about the criminal law provisions on official crimes and the law on administrative penalties for public officials, firmly establish a bottom line thinking, and do not touch the legal red line. 6. Study administrative law seriously. According to work needs, study the Administrative Licensing Law, Administrative Penalty Law, Administrative Compulsory Law, Administrative Reconsideration Law, Administrative Litigation Law, National Compensation Law, Civil Servant Law, etc., deeply grasp the basic principles of administrative law such as legal administration, reasonable administration, legitimate procedures, efficiency and convenience, honesty and trustworthiness, and unity of rights and responsibilities, firmly establish the rule of law concepts such as statutory powers, mandatory legal responsibilities, and non authorization by law, and strengthen the awareness of lawful administration.
7. Carefully study other laws closely related to performance of duties. According to work needs, study laws in areas such as social governance, "one country, two systems", foreign-related rule of law, and anti-corruption efforts; Learn laws related to China's judicial system, support and maintain fair justice; Learn administrative regulations such as major administrative decision-making procedures, government information disclosure, military regulations, and supervisory regulations, and be adept at using legal thinking and methods to plan and promote work.

Develop a list of party regulations and national laws that leaders should be aware of and should be familiar with, based on hierarchical classification. Each region and department should start from reality, distinguish different levels and positions, accurately understand and grasp the requirements of knowledge and skills, grasp the key and prominent points, fully consider work needs and learning outcomes, reasonably prepare a list of party regulations and national laws that should be known and understood, and improve the accuracy, scientificity, and effectiveness of learning. Central and state organs should take the lead in formulating a list of party regulations and national laws that leaders in their own units or industries and systems should know and understand, and play a leading and exemplary role. Establish and improve a dynamic adjustment mechanism for the list. If the Party Central Committee makes arrangements for studying and implementing newly formulated and revised Party regulations and national laws, relevant Party regulations and national laws should be promptly included in the list, and leading cadres should be organized to study seriously.
Incorporate the learning of Party regulations and national laws that leading cadres should know and understand into the cadre education system. The main leaders of the Party and government should take the lead in learning and mastering the Party's internal regulations and national laws that should be known and understood, and be a model for respecting rules, learning regulations, abiding by rules, and using laws and regulations, fully exerting their exemplary role. Incorporate Party regulations and national laws that should be known and understood into the learning content of the theoretical learning centers of Party committees at all levels, incorporate them into the teaching content of Party schools at all levels, and include them in the mandatory training courses for leadership positions and on-the-job training, ensuring the quantity and quality of training hours; Based on practical work, incorporate important content such as learning regulations and laws during government executive meetings, learning regulations and laws before unit leadership meetings, and learning regulations and laws before major decisions, and transform learning outcomes into conscious actions of making decisions and handling affairs in accordance with the law.
Establish a sound incentive mechanism for leading cadres to learn and use the law.
