Announcement No. 31 of 2023 of the Ministry of Commerce on Launching End of Period Review Investigation of Anti Dumping Measures Applicable to Imports of Halogenated Butyl Rubber Originating from the United States, European Union, United Kingdom, and Singapore
On August 10, 2018, the Ministry of Commerce issued Announcement No. 40 of 2018, deciding to impose anti-dumping duties on imported halogenated butyl rubber originating from the United States, the European Union, and Singapore from August 20, 2018. The anti-dumping tariff rates are 75.5% in the United States, 27.4% -71.9% in the European Union, and 23.1% -45.2% in Singapore, with an implementation period of 5 years.
On November 19, 2019, the Ministry of Commerce issued Announcement No. 52 of 2019, deciding to conduct a review of anti-dumping measures and dumping margins applicable to imported halogenated butyl rubber produced by ExxonMobil Corporation and ExxonMobil Chemical Co., Ltd. On November 19, 2020, at the request of relevant stakeholders, the Ministry of Commerce issued a notice terminating the review and investigation during that period.
On January 29, 2021, the Ministry of Commerce issued Announcement No. 3 of 2021. According to the announcement, after the end of the Brexit transition period on December 31, 2020, the trade remedy measures previously implemented against the EU will continue to apply to both the EU and the UK, with an unchanged implementation period.
On June 19, 2023, the Ministry of Commerce received a final review application for anti-dumping measures submitted by Zhejiang Xinhui New Materials Co., Ltd. on behalf of China's halogenated butyl rubber industry. The applicant claims that the UK has a halogenated butyl rubber industry and has been dumping exports to China. The applicant requests that the UK be included in the country under investigation for this review. The applicant claims that if anti-dumping measures are terminated, the dumping of imported halogenated butyl rubber originating from the United States, the European Union, the United Kingdom, and Singapore against China may continue or reoccur, and the damage caused to domestic industries in China may continue or reoccur. The applicant requests the Ministry of Commerce to conduct a final review investigation on imported halogenated butyl rubber originating from the United States, the European Union, the United Kingdom, and Singapore, and to maintain the anti-dumping measures against imported halogenated butyl rubber originating from the United States, the European Union, the United Kingdom, and Singapore. Shandong Jingbo Zhongju New Materials Co., Ltd. supports the application.
According to the relevant provisions of the Anti Dumping Regulations of the People's Republic of China, the Ministry of Commerce has conducted an examination of the applicant's qualifications, the situation of the investigated products and similar products in China, the import situation of the investigated products during the implementation of anti-dumping measures, the possibility of dumping continuing or recurring, the possibility of injury continuing or recurring, and relevant evidence. Existing evidence indicates that the applicant meets the requirements of Article 11, Article 13, and Article 17 of the Anti Dumping Regulations of the People's Republic of China regarding industry and industry representativeness, and is qualified to apply on behalf of the halogenated butyl rubber industry in China. The investigating authority believes that the applicant's claims and the surface evidence submitted meet the requirements for final review and filing.
According to Article 48 of the Anti Dumping Regulations of the People's Republic of China, the Ministry of Commerce has decided to conduct a final review investigation on the anti-dumping measures applicable to imported halogenated butyl rubber originating from the United States, the European Union, the United Kingdom, and Singapore starting from August 20, 2023. The relevant matters are hereby announced as follows:
1、 Continue to implement anti-dumping measures
According to the suggestion of the Ministry of Commerce, the Tariff Commission of the State Council has decided to continue to impose anti-dumping duties on imported halogenated butyl rubber originating from the United States, the European Union, the United Kingdom, and Singapore during the final review investigation of anti-dumping measures, in accordance with the scope of taxable products and tax rates announced by the Ministry of Commerce in Announcement No. 40 of 2018. The anti-dumping duty rates imposed on each company are as follows:
US companies:
1. ExxonMobil 75.5%
2. Other US companies 75.5%
EU companies:
Arang New Technology Belgium Limited 27.4%
2. Other EU companies 71.9%
UK companies:
1. ExxonMobil Chemical Co., Ltd. 71.9%
2. Other UK companies 71.9%
Singapore Company:
1. Alang Shinko Singapore Private Limited 23.1%
2. Other Singapore companies 45.2%
2、 Review and investigation period
The anti-dumping investigation period for this review is from July 1, 2022 to June 30, 2023, and the industrial injury investigation period is from January 1, 2018 to June 30, 2023.
3、 Review and investigation of product scope
The scope of products subject to review refers to the products to which the original anti-dumping measures are applicable, which is consistent with the scope of products to which the anti-dumping measures announced by the Ministry of Commerce in Announcement No. 40 of 2018, as follows:

Physical and chemical properties: Halogenated butyl rubber is a product of the reaction between butyl rubber and halogenating agents, and is an improved product of ordinary butyl rubber. The halogenation reaction includes chlorination and bromination, therefore, halogenated butyl rubber can be divided into two categories: chlorinated butyl rubber and brominated butyl rubber. Halogenated butyl rubber products are in the form of white to light amber rubber blocks. Halogenated butyl rubber has the characteristics of fast vulcanization speed, good compatibility with other unsaturated rubbers, high self-adhesiveness and mutual adhesion.
Main uses: Halogenated butyl rubber is mainly used for airtight layers without inner tubes, heat-resistant inner tubes, heat-resistant hoses and conveyor belts, pharmaceutical bottle stoppers, shock pads, adhesives and sealing materials.
This product is classified under the Import and Export Tariffs of the People's Republic of China: 40023910 and 40023990.
4、 Review content
The content of this review investigation is: If the anti-dumping measures against imported halogenated butyl rubber originating from the United States, the European Union, the United Kingdom, and Singapore are terminated, may it lead to the continuation or recurrence of dumping and damage.
5、 Register to participate in the survey
Interested parties may register with the Trade Remedy Investigation Bureau of the Ministry of Commerce to participate in the final anti-dumping review investigation within 20 days from the date of this announcement. Stakeholders participating in the investigation should provide basic identity information, the quantity and amount of the investigated products exported or imported to China, the quantity and amount of similar products produced and sold, and related information in accordance with the Reference Format for Registration to Participate in the Investigation. The reference format for registering to participate in the investigation can be downloaded from the website of the Trade Remedy Investigation Bureau of the Ministry of Commerce.
Stakeholders who register to participate in this anti-dumping investigation should submit an electronic version through the "Trade Remedy Investigation Information Platform" and submit a written version in accordance with the requirements of the Ministry of Commerce. The electronic and written versions should have the same content and consistent format.

8、 Investigation method

In order to obtain the necessary information for the investigation of this case, the Ministry of Commerce usually distributes survey questionnaires to interested parties within 10 working days from the deadline for registration and participation in the investigation as stipulated in this announcement. Stakeholders can download the survey questionnaire from the website of the Trade Remedy Investigation Bureau of the Ministry of Commerce.
Stakeholders should submit complete and accurate answers within the specified time, which should include all the information required by the survey questionnaire.
9、 Submission and processing of information
Stakeholders who submit comments, answers, etc. during the investigation process should submit electronic versions through the "Trade Remedy Investigation Information Platform" and submit written versions in accordance with the requirements of the Ministry of Commerce. The electronic and written versions should have the same content and consistent format.
If the information submitted by the interested parties to the Ministry of Commerce needs to be kept confidential, they can request the Ministry of Commerce to keep the relevant information confidential and explain the reasons. If the Ministry of Commerce agrees to its request, the interested party applying for confidentiality shall also provide a non confidential summary of the confidential information. The non confidential summary should contain sufficient and meaningful information to enable other stakeholders to have a reasonable understanding of the confidential information. If a non confidential summary cannot be provided, reasons should be provided. If the information submitted by interested parties does not indicate the need for confidentiality, the Ministry of Commerce will consider the information as public information.
10、 The consequences of non cooperation
According to Article 21 of the Anti Dumping Regulations of the People's Republic of China, when the Ministry of Commerce conducts an investigation, interested parties shall truthfully report the situation and provide relevant information. If interested parties fail to truthfully report the situation, provide relevant information, or fail to provide necessary information within a reasonable time, or seriously obstruct the investigation in other ways, the Ministry of Commerce may make a ruling based on the facts already obtained and the best available information.

This survey will start on August 20, 2023 and should be completed before August 20, 2024.
