The content shows that the defendant Li Mousheng committed the crime of intentional injury and was sentenced to one year and six months in prison. Ms. Quan told Zhengguan News that she plans to abandon the appeal.
The court issues a personal safety protection order
According to the WeChat official account of Yongding Public Security Bureau, at 17:46 on February 7, the Yongding Branch of Zhangjiajie Public Security Bureau received a report from a woman that her daughter had a conflict with her son-in-law near a community, resulting in her neck injury. After receiving the alarm, the Yongding Public Security Bureau immediately dispatched police to the scene for disposal, and promptly sent the injured to the hospital for treatment. The injured were not in life-threatening condition, and at the same time, the police force was quickly organized to conduct investigations, evidence collection, and pursuit and arrest work.
After investigation, at around 17:00 on February 7, 2023, the suspect Li and his wife Quan got into a conflict due to a family dispute. They used a fruit knife and injured Quan's neck. Li called 120 and fled the scene. At around 21:00 on the same day, the suspect Li surrendered to the public security organs.
On the afternoon of February 8th, Li was administratively detained for 10 days in accordance with the law for intentionally harming someone else's body. According to judicial appraisal, Quan was found to have minor injuries, and Li has been criminally detained by the public security organs in accordance with the law. The case is currently under further investigation. The police will strictly handle the situation in accordance with the law and resolutely safeguard the legitimate rights and interests of the victims.
On the noon of February 15, 2023, under the contact of the Women's Federation of Yongding District, Zhangjiajie City, the victim Ms. Quan applied to the People's Court of Yongding District for the adoption of personal safety protection measures. At around 16:30 on February 15, 2023, the People's Court of Yongding District, Zhangjiajie City conducted an efficient review in accordance with the law and issued the first personal safety protection order for 2023.
Sentenced to one year and six months in the first trial
From the verdict released by Ms. Quan on social media, it can be seen that the defendant Li Mousheng committed the crime of intentional injury and was sentenced to one year and six months in prison. The defendant Li Mousheng should compensate the plaintiff with a total of RMB 9796.84. Ms. Quan added that this result surprised her. Regarding the suggestions from many netizens to continue appealing, Ms. Quan also stated that she only has the right to appeal in the civil part and can only apply for a protest in the criminal part. She replied, "I have applied, but there is not much hope.".
At the same time, she also issued a criminal protest application, which includes the criminal judgment part of the first instance criminal incidental civil judgment of the case by the People's Court of Yongding District, Zhangjiajie, Hunan Province. One of the reasons for filing a protest is that she believes that "the first instance was convicted of intentional injury, and the case was convicted of a serious crime with a light sentence, indicating inappropriate application of the law.".
On the afternoon of July 18th, Ms. Quan responded to Zhengguan News reporters that she planned to abandon her appeal. But it has not responded to questions such as whether a criminal protest application has been filed and the outcome.
