On August 2nd, the Supreme People's Court held a press conference to release typical cases of people's courts practicing socialist core values with fairness and efficiency.
At the meeting, Duan Nonggen, Director of the Research Office of the Supreme People's Court, stated that in order to deepen the practice of socialist core values, fulfill the important responsibilities and missions of the People's Court in distinguishing right from wrong, stirring up turbidity and promoting justice, and punishing evil and promoting good, in accordance with relevant work arrangements, the Supreme People's Court closely revolves around the theme of "fairness and efficiency", practices socialist core values, releases this batch of typical cases, uses "small cases" to explain "great principles", actively spreads truth, goodness, and beauty, conveys positive energy, and tells the story of China's rule of law well.
It is reported that these 15 typical cases were carefully selected from excellent judicial cases collected by national courts to promote socialist core values, after careful research, soliciting opinions, and multiple arguments.
Compared with several typical civil cases previously released by the Supreme People's Court to promote socialist core values, this batch of typical cases highlights its comprehensive characteristics: covering civil and administrative cases in terms of types, including disputes over the right to life and health, labor disputes, support disputes, inheritance and support agreement disputes, restoration of status disputes, commercial defamation, service contract disputes, etc. in terms of specific causes of action; In terms of values leading themes, it involves topics such as protecting the reputation and honor of heroes and martyrs, protecting the rights and interests of workers, protecting the rights and interests of the elderly, protecting the rights and interests of property owners, operating with integrity, being honest and trustworthy, acting bravely for righteousness, and willing to take risks. This batch of cases demonstrates that the people's courts have increased the trial of cases related to people's livelihoods, promoted the formation of good social relations and atmosphere, and effectively integrated the practice of socialist core values into all aspects of the judicial trial process.
This batch of typical cases actively responds to the people's demands for strengthening rights protection and better maintaining fairness and justice, making the people's sense of gain, happiness, and security more secure. For example, actively safeguarding the legitimate rights and interests of workers and helping to build harmonious and stable labor relations are the goals pursued by people's courts in handling labor dispute cases. In the case of Lincang Housing and Urban Rural Development Bureau v. Lincang Human Resources and Social Security Bureau's Qualification Determination for Work Injury Insurance, Dai was diagnosed with brain death and was not recognized as a work injury due to the hospital's organ donation surgery, which resulted in the hospital issuing a death certificate for more than 48 hours. The people's court corrected the unreasonable decision not to recognize a work injury in accordance with the law, safeguarded the legitimate rights and interests of the parties involved in accordance with the law, did not hinder social welfare efforts, and guided the masses to be positive and upward.
The press conference also mentioned that the people's court should make judgments in a neutral and impartial manner, distinguish right from wrong, determine and stop disputes, effectively safeguard the legitimate rights and interests of the people, provide a "statement" to the parties involved, and explain social fairness and justice. Resolutely prevent the practice of "making trouble, being unreasonable, being injured, and being reasonable", so that the judiciary has strength, right and wrong, and warmth, and returns to its original source to defend fairness and justice. For example, in the case of Zhang v. Shanghai Metro Operation Co., Ltd. and a security service company over the right to health dispute, the plaintiff was stopped and injured by the security personnel who did not cooperate with the security check. During this period, the security personnel did not use violence or engage in any other extreme behavior, and obstructing the plaintiff from entering the station was a legitimate act of fulfilling the security check responsibilities. Therefore, the plaintiff's demand for the defendant to bear the liability for infringement damages lacks basis, and the people's court rejects the plaintiff's lawsuit request. This case clearly states that those who fail to comply with the management order of public places and cause harm to themselves should bear corresponding responsibilities for the consequences of the damage. Those who perform their duties in a legitimate manner shall not be held responsible, and the social governance requirements put forward by the Party Central Committee of "making law-abiding and disciplined individuals proud and making it difficult for law-abiding and immoral individuals to act" shall be truly implemented and implemented.
