State owned enterprise CEO falsely accuses subordinates, Yunnan reports rare cases: harboring resentment and falsely accusing and framing after being reported problems | Liu | Commission for Discipline Inspection and Supervision | Reporting | False accusation | Superior | Zhang | Problem
False accusers are mostly of the same level or subordinates, and it is not common for superiors to falsely accuse subordinates.
On June 8th, a case was reported on the website of the Yunnan Provincial Commission for Discipline Inspection and Supervision, stating that Hu, the general manager of a state-owned company in a certain city of Yuxi City, harbored a grudge against Wei, an employee of the company's finance department, for reporting problems in his work to the organization. In retaliation against Wei, he instructed Liu, the finance department manager, to fabricate a shortage of over 700000 yuan of materials in Wei's warehouse during his tenure as the company's warehouse administrator. Wei was suspected of embezzlement of his position and reported the case to the economic investigation department of the public security organs, intending to hold Wei criminally responsible.
Wei reported to the disciplinary inspection and supervision authorities the issue of Liu and others falsely accusing and framing him, and the disciplinary inspection and supervision authorities transferred the relevant clues to the public security organs for disposal. After investigation and verification by the public security organs, it was found that Hu and Liu's behavior was suspected of false accusation and framing, and the case was transferred to the procuratorate for prosecution. Hu and Liu were sentenced to one year and six months and one year respectively for committing the crime of false accusation and framing. Due to their other criminal issues, they were ultimately sentenced to 25 years and six months and four years respectively, with fines.
The Yunnan Provincial Commission for Discipline Inspection and Supervision stated that in real life, a small number of people want to use the legal obligations of the Commission for Discipline Inspection and Supervision to "benefit themselves", deliberately fabricate and distort facts, with the intention of attacking others and fulfilling themselves. However, they are unaware that such behavior itself is a violation of discipline and law, which not only harms others but also oneself.
According to a previous report by "Anti Corruption Outlook", there are usually two situations where superiors falsely accuse subordinates. One way is that superiors want to manipulate people while also clarifying responsibility; Another type is that the upward trend of subordinates makes superiors feel threatened and deliberately suppress them. "Using false accusations to attack superiors or peers is already very despicable. As a superior, using these techniques against subordinates shows that their character is too poor." Someone commented.
A person familiar with the situation introduced that a senior official at the ministerial level who fell from power after the 18th National Congress of the Communist Party of China had engaged in false accusations against his subordinates during his political experience. At that time, he was holding a deputy provincial position and although he held great power, he did not want to offend anyone. He instructed someone to write a letter to their superiors, falsely accusing an official of lower rank than himself. After the superior approved these letters, he immediately initiated the investigation procedure. Externally, he still pretends to be a good person, saying that he doesn't want to mess with anyone. It's because there is a lot of pressure on him and he has to take action.
Nowadays, false accusations are receiving increasing attention.
Pengpai News has noticed that since the beginning of this year, the Yunnan Provincial Commission for Discipline Inspection and Supervision has issued three consecutive issues to investigate and punish false accusations and framing, carry out clarification and rectification, and motivate cadres to take on responsibilities as work cases.
For example, Liu, a cadre from a certain town in Lufeng City, Chuxiong Prefecture, and Sha, a social worker, attributed the poor operation of their contracted breeding farms, farmhouses, and hot spring projects to the town's party committee and government's failure to harden the road leading to their business premises. They also believed that the town's party secretary, Zhang, was deliberately causing trouble, so they jointly planned to collect materials that were unfavorable to Zhang and retaliate against him in a timely manner. Later, when Liu heard that Zhang was recommended as a department level cadre and was undergoing organizational investigation, he asked Sha to distribute over 300 false reporting materials that had been prepared in advance, reflecting Zhang's corruption and bribery issues, to the basketball court of a certain city's official center twice, causing a negative impact on society.
The notice states that Liu and Sha were punished by the municipal public security organs with administrative detention and fines for intentionally falsely accusing, framing, insulting, and defaming others through fabricating facts and scattering reporting materials, and causing negative social impact. Liu was also expelled from the party.
Pu'er City management cadre Zhang learned that Zhou was planning to be promoted to the department he was in charge of. Due to his strong abilities, he believed that Zhou's appointment to the department might steal his limelight, be difficult to control, and be difficult to manage. He collected and organized some hearsay and discussions, and wrote four anonymous report letters to send to relevant departments and leaders, reflecting that Zhou had four aspects of disciplinary and illegal issues, with the intention of preventing him from being promoted and appointed. After careful verification by the Discipline Inspection Commission and Supervision Commission of Pu'er City, the issues reported are not true, and it is determined that their actions constitute false accusations and framing.
The notice stated that Zhang was given a serious warning within the party and a major disciplinary record for government affairs; Zhang was also disqualified as a representative of the Municipal People's Congress and his position as a representative of the Municipal People's Congress was terminated.
During the period when Liu, a cadre in Jinghong City, Xishuangbanna Prefecture, was seconded to work with police officer Zhang, he believed that he had been suppressed and excluded by Zhang. In order to vent his personal anger without factual basis, he delivered six anonymous false reports through the post office twice, and made two false reports through the online reporting platform. He falsely reported Zhang's bribery behavior in the name of a released person after serving his sentence, and reported Zhang's unfair economic and sexual relationships with others in the tone of Zhang's wife, with the intention of causing Zhang to be punished for party discipline and government affairs. After investigation and verification by the disciplinary inspection and supervision team of the Provincial Department of Justice, it was found that the issues reported were not true. The clues found during the investigation and verification that Liu was suspected of false accusation and framing were transferred to the Discipline Inspection Commission and Supervision Commission of Xishuangbanna Prefecture for processing. After investigation and verification by the Discipline Inspection Commission and Supervision Commission of Xishuangbanna Prefecture, Liu's behavior has constituted false accusations and framing.
According to the announcement, Liu was given a serious warning within the party and a major administrative demerit, and was transferred from his original unit.
