Someone once shouted, "I look down on you if I don't jump." A 20-year-old woman jumped off a building and died. Girl | Video | Woman
Recently, a netizen posted a video stating that a 20-year-old girl jumped to her death in an apartment building in Yongkang City, Jinhua, Zhejiang. According to online rumors, before the girl jumped from the window sill, someone shouted, "I look down on you if I don't jump.". After the girl jumped off a building and died, her family now wants to hold the caller accountable.
According to media reports, Mr. Feng, the video publisher, claimed to be a friend of the deceased's family. Now that the family has reported the incident, the deceased's mother, Ms. Jiang, believes that the instigator's remarks are related to her daughter's death. After the instigator finished speaking for two or three seconds, her daughter jumped off the building.
In addition, Mr. Feng also stated that in response to the situation where multiple people were shouting, the police informed the family members, and another person said "arrest you" was aimed at the first instigator, not at the deceased.
On August 12th, another relative of the deceased claimed that personnel had already gone to the police station for investigation. The staff of the police station stated that the police had already called out at that time, and they had recorded the situation of the rioters reported on the scene, but it was inconvenient to inform them of the specific situation.
Lawyer Ding Jinkun from Shanghai Dabang Law Firm told reporters that although the instigator does not constitute a crime, civil and administrative responsibilities can still be pursued. Firstly, this kind of sitting on the ground causing disturbance to social order has social harm and belongs to provocative and troublemaking behavior, which can be punished by public security. Article 26 of the Public Security Administration Punishment Law stipulates that "those who engage in any of the following behaviors shall be detained for not less than five days but not more than ten days, and may also be fined not more than 500 yuan; if the circumstances are serious, they shall be detained for not less than ten days but not more than fifteen days, and may also be fined not more than 1000 yuan: those who engage in gang fights; those who chase or intercept others; those who forcibly take or arbitrarily damage or occupy public or private property; and other provocative and troublemaking behaviors.".
Secondly, if there is a causal relationship between instigation and death, that is, if the instigation is heard and effective by the victim, then the instigator is subjectively at fault and objectively causes consequences, and must bear civil infringement. The heir of the deceased can sue the instigator, demand civil compensation for losses, and bear a certain proportion of death compensation.
