It is reported that starting around 2021, Yu illegally processed other people's facial information using "AI face changing" software without obtaining the consent of the edited person, replacing and synthesizing it with facial information in some videos to generate fake face changing videos. The prosecution believes that the above-mentioned behavior infringes on public information security carried on the personal information of an unspecified majority of social subjects, disrupts social public order, and constitutes an infringement of social public interests in the field of public information security. They request the court to order Yu to bear civil liability.
The Hangzhou Internet Court held that facial information is the most important biometric information among sensitive personal information, which is related to personal dignity, personal safety and property safety of individuals, and its abuse involves the public interests of unspecified social groups. Yu used facial recognition software to deeply synthesize fake videos and images. Without the consent of the information subject, he collected, extracted, replaced, synthesized, and stored a large amount of sensitive facial information from others, and published the deeply synthesized fake videos and images in multiple social media groups of over 2000 people. At the same time, providing customized facial replacement services for others without specific subjects, and selling facial replacement software and teaching technical tutorials for profit, illegally benefiting tens of thousands of yuan, constitutes infringement of personal information rights. Mr. Yu published synthetic and forged videos and pictures in online groups, which is highly likely to spread and has a wide range of influence, making potential social unspecified groups likely to be victims of aggression, more likely leading to the formation of the public's psychological expectation of "seeing is not believing", undermining the trust of the social community in the Internet digital world, and damaging the social and public interests in related fields.
