Restrict journalists, lawyers, and group tours? Lawyer: Or suspected of illegal disclosure | Travel agency | Reporter
According to media reports, a news professional recently revealed on his social media that he was advised by customer service not to join a Yunnan travel agency during an online group buying booking due to holding a press card.
Mr. Li, a news professional, said that when communicating with platform staff about travel matters, he asked an extra question: "Is there a discount or free admission for having a press card?" Unexpectedly, the other party immediately called to verify his identity. After confirmation, he suggested that Mr. Li should not join the tour group, saying that this type of tour group definitely cannot withstand scrutiny and he cannot take such a big risk
Why do tour groups prohibit journalists from joining them? Is this phenomenon common? Is the approach reasonable?
"Private customization is possible, but not with a group"
On the 19th, the reporter browsed multiple group travel pages on an online travel platform and found that there were age restrictions, crowd restrictions, and other restrictions in the booking restrictions column. But many do not accept reservations for pregnant women, and there are no professional restrictions such as journalists.

Will there be situations where journalists are unable to book during the actual booking process? China News Finance reporters randomly dialed the phone numbers of multiple Yunnan travel agencies, and received varying responses.
For example, a staff member of a travel agency in Yunnan clearly stated that journalists can customize privately, but cannot join a group, let alone enjoy press card discounts.

When asked about the reason by a journalist from Zhongxin Finance, he said, "There is no reason. If you participate as an ordinary person, there are no restrictions." He also mentioned, "Not only in Yunnan, but everywhere you go, it's like this."
The other two travel agencies in Yunnan consulted by the reporter both stated that there is no such thing as "journalists cannot join the group", but they do not enjoy the press card discount. Among them, a travel agency employee from a certain online travel platform also mentioned, "There cannot be such discrimination against tourists. There may be such claims in low-priced shopping groups within the industry, and we do not recommend applying for such groups."
In response to the aforementioned staff's claim that this situation also exists in other places, the reporter consulted a travel agency in Hunan, and the other party suggested using a pure play group, as long as they do not claim to be journalists.
Recently, there have been media reports that the customer service manager of Kunming China International Travel Service stated that the company basically does not accept this sensitive industry, for example, some companies such as lawyers will not accept it.
On the 19th, Kunming China International Travel Service Co., Ltd. issued a statement stating that the company has paid attention to online reports about "some travel agencies in Yunnan prohibit journalists and lawyers from attending delegations: do not accept customers from 'sensitive industries', and are afraid of being photographed for shopping itineraries". The company has conducted a comprehensive review of the content of the reports and has not yet found any involvement in the company's business.
Kunming China International Travel Service issued a statement on Tiktok.
However, according to the travel agency staff in Hunan mentioned above, some shopping groups previously had identity restrictions such as journalists and lawyers.
Lawyer: This practice by travel agencies may be suspected of being illegal

Is it reasonable for travel agencies to suggest that they cannot join a group as they work as journalists or lawyers?
"This practice restriction is not only unreasonable, but may also be suspected of being illegal," Yan Bing, senior partner of Beijing Times Jiuhe Law Firm, told China News Finance reporters. The "Consumer Rights Protection Law of the People's Republic of China" stipulates the principle of equality and rules prohibiting differential treatment. It is understandable that merchants impose restrictions on consumer groups in their business activities based on personal safety or the specificity of their business projects, but the occupational restrictions in this incident are clearly not well intentioned.
Yan Bing believes that the language used by the merchants in this exposed incident, which has a negotiating nature, cannot be directly classified as illegal. But if the merchant has mandatory refusal behaviors such as prohibition, it should be deemed illegal.
The government service staff of Yunnan Province also told China News Finance reporters that there is no situation in Yunnan where journalists are not welcomed for tourism. "Once this situation occurs, we will respond 24 hours a day and hand it over to the corresponding functional department for implementation and handling."
A journalist from Zhongxin Finance noticed that in 2017, a Yunnan tour project on a certain tourism website explicitly stipulated that journalists and people from Jiaozuo, Zhumadian, Liling, Hunan, Jieyang, Guangdong and other places in Henan were prohibited from participating in the tour.
At that time, the Zhejiang Travel Agency Association also issued a document stating that it was absurd for travel agencies to ban journalists from registering. The article states that prohibiting journalists from participating in the delegation is a clear form of identity discrimination, which is both contrary to industry ethics and has the suspicion of illegality. Simply considering this prohibition clause itself, it is childish and ridiculous.
The article also mentioned that "banning journalists" not only fails to beautify the image, but is actually a self deprecating behavior that is publicized in advance. A travel agency with a good image and standardized operation does not need to guard against journalists at all. Only travel agencies that enjoy fraudulent operations and ignore consumer rights will fear and guard against journalists, and be full of hostility and fear towards journalists.
