On September 28, 2022, the Public Security Bureau of Yibin City, Xuzhou District Public Security Branch, Xuzhou District Procuratorate, and Xuzhou District Court jointly reported on the counterfeit drug case involving 31 provinces in China with a total amount of 210 million yuan. After in-depth reporting by Red Star News, it has attracted national attention.
On June 14th, the People's Court of Xuzhou District, Yibin City, Sichuan Province released the trial information of the "Jiulong Traditional Chinese Medicine Pill" counterfeit drug case: the defendant Chen was sentenced to 14 years in prison and fined RMB 124 million for the crime of producing and selling counterfeit drugs; For the crime of producing counterfeit drugs or selling counterfeit drugs, the remaining six defendants shall be sentenced to imprisonment ranging from three years to six years and six months, as well as corresponding additional penalties.
According to a court notice, in May 2017, the defendant Chen rented a house and hired personnel to produce drugs such as "Jiulong Traditional Chinese Medicine Pills" and "Jiulong Traditional Chinese Medicine Pills". In June 2020, the defendant Deng and others were arranged by Chen to mix various Western medicine drugs such as dexamethasone, naphthopam tablets, acetaminophen tablets, and betamethasone with Jianqu and fennel in a certain proportion according to the "formula" provided by Chen. They were crushed with a grinder, mixed with flour, and made into granular pills. Then, the prepared pills were packed in "Jiulong Traditional Chinese Medicine Pills" and "Jiulong Traditional Chinese Medicine Pills" bags, and then packaged in plastic handbags according to the standard of 50 bags per lift.
The defendant Chen impersonated "Jiulong Traditional Chinese Medicine Pills" and "Jiulong Traditional Chinese Medicine Pills" as traditional Chinese medicine, and sold them to the public through a verified WeChat account at a price of 100 yuan per bag, and bound them to corresponding bank cards to collect payment; Chen sent the buyer's information to the courier via WeChat, and arranged for the defendant Zhao and others to transport the packaged "Jiulong Traditional Chinese Medicine Pills" and "Jiulong Traditional Chinese Medicine Pills" to the postal express delivery point in the form of express delivery to various parts of the country. After appraisal by an accounting firm, Chen produced and sold "Jiulong Traditional Chinese Medicine Pills" and "Jiulong Traditional Chinese Medicine Pills" with a total amount of over 73.62 million yuan.
Why do some patients believe that "Jiulong Traditional Chinese Medicine Pills" are helpful for their condition? "After testing, it was found to contain a large amount of hormone prescription drugs and pain relieving tablets. Some people even thought that these traditional Chinese medicine pills had good effects after taking them, but in fact, the hormones and pain relieving tablets were mainly at work. The more than 100 precious Chinese herbal medicines mentioned in the promotion are also non-existent, completely fake and inferior products." explained Wu Xiaoke, the leader of the Food and Drug Crime Investigation Brigade of the Yibin Public Security Bureau.
According to the Market Supervision Administration, chemical ingredients such as aspirin, prednisone acetate, acetaminophen, diclofenac sodium, and betamethasone were detected in the "Jiulong Traditional Chinese Medicine Pills" and "Jiulong Traditional Chinese Medicine Pills" produced and sold by the defendant Chen and others. However, the raw materials used for external promotion are traditional Chinese medicine, which constitutes impersonation of other drugs and is classified as fake according to law.
The People's Court of Xuzhou District, Yibin City, taking into account the criminal circumstances, roles in criminal organizations, and confession attitudes of each defendant, made a judgment in accordance with the law, sentencing the defendant Chen to 14 years in prison and a fine of RMB 124 million for the crime of producing and selling counterfeit drugs. For the crime of producing counterfeit drugs or selling counterfeit drugs, the remaining six defendants shall be sentenced to imprisonment ranging from three years to six years and six months, as well as corresponding additional penalties.
It is understood that this case is the main case of a large-scale production and sales of counterfeit drugs involving 31 provinces, municipalities directly under the central government, autonomous regions, and involving a total amount of over 100 million yuan, which was cracked in the Yibin Public Security Bureau's notice in 2022. In this case, the defendant, Mr. Chen, rented a place and organized personnel to mix various western medicines and traditional Chinese medicines into pills to pretend to be pure Chinese medicine, sold them on the Internet, and then delivered them by mail. The criminal means were hidden, but the spread and influence were great, and social harm was serious. The People's Court punished the criminal severely according to law.
The Xuzhou District Court stated that the majority of the victims in this case are middle-aged and elderly people. Many middle-aged and elderly people, upon hearing pure Chinese medicine with miraculous effects, will have the idea of buying and trying it out. There are even many people who believe in folk remedies and mistakenly administer fake drugs to folk or divine remedies, which has the opposite effect. Due to the limitations of medical technology, many diseases cannot be completely cured. Therefore, criminals intentionally cater to the psychological needs of some patients who seek medical treatment but are unable to recover for a long time by labeling the packaging of traditional Chinese medicine bags with words that can treat various diseases such as headaches, dizziness, and rheumatoid arthritis, in order to seek illegal benefits. This case reminds consumers to be vigilant and not believe in false advertising such as "ancestral secret formulas". They should go to regular pharmacies and hospitals to purchase medication and ensure medication safety.
