Guangxi: Cross border smuggling gang successfully caught and cut off a smuggling channel
Recently, the Guangxi Fangchenggang Border Management Detachment spent a year dismantling a major organized smuggling gang case. In August 2022, the Fangchenggang Border Management Detachment discovered suspicious individuals operating near the border through border warning equipment and arrested six illegal immigrants on the spot. After a surprise interrogation, the police arrested 3 organizational transporters and 11 illegal immigrants in the surrounding area. Both groups of illegal immigrants claimed to be tempted by "high paying overseas work" and attempted to illegally cross the country under the arrangement of "snake heads".
In the subsequent in-depth investigation, the police arrested "Snake Head" Chen and 5 drivers responsible for organizing transportation, as well as 23 illegal immigrants. After the gang led by "Chen" was arrested, the task force continued to closely monitor important clues and found that behind "Chen" there were five clearly defined illegal immigration criminal gangs, involving both domestic and overseas activities.
The temptation of high paying overseas jobs and clear division of labor among gangs

The police officers of the task force introduced that these groups have specialized members who impersonate recruiters and post so-called "high paying recruitment" information on various social media platforms in China to attract others to contact them. Once someone is hooked, other members can remotely control these people to illegally cross the border.
Police officers from the Fangchenggang Border Management Detachment of Guangxi Border Inspection Station: These six gangs used phones, WeChat, and other means of communication with each other when committing crimes. They followed the instructions of overseas "snake heads" and, like a long-distance relay, transported illegal immigrants in segments, batches, and bypassing customs to evade police crackdowns.
Due to factors such as the large number of personnel involved, wide geographical range, and long organizational chain in the following five gangs, this series of gang cases has been upgraded to cases supervised by the National Immigration Administration, and has closely cooperated with the public security organs of Fujian Province. After six months of meticulous investigation, 10 network operations have been carried out, capturing 42 organized transporters, 103 illegal immigrants, 23 involved vehicles, 7 transit points, and 6 organized illegal immigration criminal gangs. The entire chain has cut off a cross-border illegal immigration channel, effectively deterring cross-border criminal activities.
Starting from February this year, the People's Court of Dongxing City, Guangxi Province, has successively announced the first instance verdict on the personnel involved in six gangs. As of now, the defendant Chen and 32 others have been sentenced to imprisonment ranging from 1 year to 3 years and 9 months, and have also been fined. 36 people have been sentenced to imprisonment ranging from 7 months to 11 months, and have also been fined, for the crime of organizing or transporting others to illegally cross the border. Another 60 people have been administratively punished by the public security organs.

Experts believe that safeguarding the legitimate rights and interests of Chinese citizens and strengthening international judicial assistance are important measures to effectively combat cross-border crimes.

If the maximum sentence is three years or less, it can be disregarded. However, our Chinese criminal law is applicable to such behavior of Chinese citizens who are harmed overseas. Although the criminal is overseas, we are temporarily unable to take any corresponding coercive measures against him. However, as long as he enters China, we can immediately take corresponding investigation measures against him. Even if he is overseas, we can hold him criminally responsible by strengthening international law enforcement and judicial cooperation.
