This report reports that the green area of Changying Sports Park in Chaoyang District covers an area of more than 6000 square meters and houses 23 ostriches. The lessee of the venue has been arguing over the issue of lease termination for many years, and the court's judgment has also delayed the performance. Recently, with the cooperation of multiple departments, the Chaoyang Court forcibly vacated the site involved in the case. After 9 hours, 23 ostriches, wood, equipment and other items were properly placed in the site.
Mr. and Mrs. Zhu, who were executed, are villagers from a certain village in Chaoyang District. In 1983, the couple registered a company and rented collective land in the village to build a factory for operation, producing doors and windows. Starting from 1993, they began raising ostriches on the site. In 2005, according to the plan, the area where the site was located was used to build a green isolation belt. The village economic cooperative and Mr. Zhu and his wife negotiated multiple times. In August 2009, both parties signed a termination agreement, which stipulated that the original lease contract would be terminated, and the village collective would compensate the two companies with over 7 million yuan. Mr. Zhu was required to vacate and transfer the above ground objects within two days from the signing of the agreement, and the compensation would be paid in two installments after the agreement was received. However, Mr. Zhu did not transfer the site according to the agreement. After the village economic cooperative filed a lawsuit, the court ruled in accordance with the law that the couple vacated the venue.
When the village economic cooperative applied to the court for enforcement, the area where the involved site was located had already been built into the current Changying Sports Park. Once put into use, Changying Sports Park has been deeply loved by nearby residents. However, the site involved has always occupied a corner of the park, which not only hinders the further optimization of the park's functional space, but also greatly affects the park experience due to the accumulation of debris and unpleasant odor caused by ostrich breeding.
The executing judge repeatedly urged Mr. and Mrs. Zhu and their company to fulfill their evacuation obligations as soon as possible, deliver the site, and posted a evacuation notice on site, ordering them to fulfill within a specified time limit, but the couple still failed to do so. Recently, the Chaoyang Court joined forces with multiple departments to carry out forced evictions.
At the evacuation scene, the executing judge saw no response when knocking on the door, and ordered the law enforcement officers to climb over the wall and quickly investigate the situation of each house in the courtyard. After confirming that there was no one on the site, the gate was forcibly demolished. During the execution process, the judge contacted Mr. Zhu by phone and informed the couple of the situation where the forced evacuation would take place on that day, the location of the items to be placed, and the relevant rights and obligations, requesting him to return as soon as possible to confirm the handover. Mr. and Mrs. Zhu expressed willingness to cooperate with the court in carrying out their work.
Immediately, the on-site notary began to count the items, and then the moving company packed and numbered them for removal. 23 ostriches were also transported to the resettlement location provided by the applicant for enforcement. During the evacuation work, Mr. and Mrs. Zhu rushed to the scene and reconfirmed the items on site. After 9 hours, the evacuation work was completed, and the court returned the venue to the village economic cooperative of the applicant for enforcement.
