Notice of the National Development and Reform Commission and Other Departments on Implementing Several Recent Measures to Promote the Development of Private Economy

In order to thoroughly implement the decisions and deployments of the Central Committee of the Communist Party of China and the State Council on promoting the development and growth of the private economy, fully implement the Opinions of the Central Committee of the Communist Party of China and the State Council on Promoting the Development and Growth of the Private Economy, promote the resolution of prominent problems faced in the development of the private economy, stimulate the vitality of the private economy, and boost confidence in the development of the private economy, the following measures are proposed.
1. to promote equitable access
1. Among the major national projects and short board projects, select projects with a certain level of income and relatively mature conditions to form a list of major projects that encourage private capital to participate. By holding major project promotion meetings and opening columns on the national investment project online approval and supervision platform, we will release project information to private enterprises and actively guide the implementation of projects. In contrast to the above initiatives, all regions have formed a list of projects that encourage private capital to participate and strengthened their promotion.
2. Expand the issuance scale of real estate investment trust funds in the infrastructure sector, promote the issuance of infrastructure REITs by eligible private investment projects, and further expand private investment.
3. Support private enterprises to participate in major scientific and technological breakthroughs, and take the lead in undertaking breakthroughs in industrial software, cloud computing, artificial intelligence, industrial Internet, gene and cell medicine, new energy storage and other fields.
4. Enhance the supply capacity of private enterprises in key links of the industrial and supply chains, and cultivate a group of characteristic industrial clusters of small and medium-sized enterprises in counties across the country.
5. Promote the healthy development of the platform economy and continuously launch "green light" investment cases for platform enterprises.
6. Support specialized, refined, and innovative "little giant" enterprises and high-tech enterprises to register at local national intellectual property protection centers, and carry out rapid pre examination, rapid property rights confirmation, and rapid rights protection.
7. Carry out certification and upgrading actions for the quality management system of private enterprises, and enhance their quality and technological innovation capabilities. Support private enterprises to lead the establishment of international industry and standard organizations. Continuously carry out the "Measurement Service for Small and Medium Enterprises" activity, support private enterprises to participate in the construction of industrial measurement testing centers, and enhance the advanced measurement capabilities of private enterprises.
8. In accordance with the requirements of "Several Measures to Assist Small and Medium sized Enterprises in Stable Growth, Structural Adjustment, and Strong Capacity", the policy deadline for increasing the reserved share of government procurement projects for small and medium-sized enterprises to over 40% is extended until the end of 2023. Accelerate the progress of contract payment, use credit guarantees, and provide convenience for small and medium-sized enterprises to participate in procurement activities.
9. Carry out special governance on prominent issues in engineering construction bidding and tendering, adopt measures such as administrative penalties, supervision and rectification, and notification of cases, and concentrate on solving a group of local protection and ownership discrimination issues that are strongly reflected by private enterprises. Support various regions to explore the application of electronic business licenses in bidding platform login, signature, online contract signing, and other businesses.
10. Revise and introduce a new version of the negative market access list, promoting all types of business entities to enter industries, fields, and businesses outside the list on an equal basis in accordance with the law.
2. strengthen factor support
11. On the basis of the two time points of the pre-payment declaration period of enterprise income tax in October of the current year and the settlement period of January-May of the following year, the pre-payment declaration period in July of the current year shall be added as the time point for enjoying the policy, and the qualified industry enterprises may declare and enjoy the policy of adding and deducting R & D expenses according to the regulations.
12. Continuously ensure that the average processing time for normal export tax refunds for export enterprises is within 6 working days, and compress the average processing time for normal export tax refunds for Class I and Class II export enterprises to 3 working days. The policy will continue to be implemented until the end of 2024. Update and release national investment tax guidelines to help private enterprises better prevent cross-border investment tax risks.
13. Extend the term of the support tool for inclusive small and micro loans until the end of 2024, and continue to increase the support for inclusive finance. Guide commercial banks to access financing credit service platforms such as Xinyi Loan and local credit reporting platforms, and strengthen cross departmental credit information connectivity. Expand the scale of credit loans for private enterprises. Effectively implement the management system for bad debt verification of financial enterprises.
14. Expand the new model of central local cooperation for credit enhancement of private enterprise bonds to all types of private enterprises that meet the issuance conditions, and form more demonstration cases as soon as possible.
15. Adapt to the land needs of private small and medium-sized enterprises, explore the implementation of industrial chain land supply, and implement overall supply of multiple land related to industrial chain related projects.
16. In addition to laws, regulations, and relevant policies, within the scope of urban planning and construction land, the investment interface of water supply, gas supply, and power supply enterprises shall be extended free of charge to the red line of enterprise building zoning.
17. Empower private enterprises with the right to evaluate their professional titles, and allow private enterprises above designated size with strong technical capabilities to independently or jointly establish professional title evaluation committees to conduct independent evaluations.
3、 Strengthening legal protection
18. Clean up and abolish regulations and normative documents that violate the principle of equal protection for all types of ownership economy, and strengthen protection and support for the development of private economy.
According to Article 33 of the Administrative Penalty Law of the People's Republic of China, specific situations for not imposing penalties are clearly defined in key areas such as urban management, ecological protection, and market supervision. Introduce the Guiding Opinions on Further Regulating the Setting and Implementation of Administrative Fines for Supervision. Carry out a special clean-up of fines in administrative regulations and departmental rules, and the results of the clean-up will be made public to the public.
4. optimization of enterprise-related services
20. We will comprehensively build a pro-Qing political and business relationship, support various regions in exploring different ways to serve private enterprises, make full use of digital means such as the national integrated government service platform to improve preferential policies and service efficiency, and take multiple measures to help private enterprises solve problems and difficulties.
21. Establish a management system for the list of intermediary service items related to enterprise administrative licensing. Matters that are not included in the list will no longer be accepted as conditions for administrative approval. In the future, if it is necessary to establish new ones, they will be set up and included in the list management in accordance with legal procedures. Incorporate intermediary service matters into integrated government service platforms at all levels, achieve online processing of the entire process of institution selection, fee payment, report uploading, service evaluation, etc., and publicly accept social supervision.
22. Increase efforts to clean up outstanding accounts owed to private enterprises, with a focus on clearing up outstanding accounts owed to small and medium-sized enterprises by government agencies, public institutions, and state-owned enterprises. The audit department accepts debt clues reported by private enterprises and strengthens audit supervision.
23. Fully implement the system of simple and ordinary deregistration, and improve the "One Network Service" platform for enterprise deregistration. Improve supporting policies and measures for the closure system.
24. Unless confidentiality is required by law, the formulation and revision of policies related to enterprises should fully listen to the opinions and suggestions of entrepreneurs. The adjustment of policies related to enterprises should establish a reasonable transition period.
5. create a good atmosphere
25. Unblock complaint channels involving enterprises at different levels. Set up special announcements on the "Internet Supervision" platform of the State Council for soliciting enterprise-related issues. Set up special columns on the complaint and suggestion system of the national government service platform for soliciting enterprise-related issues. Each region, in combination with its own reality, will incorporate enterprise-related complaints into government service platforms such as the "12345" hotline and establish a tracking mechanism for transfer and rectification. Continue to carry out the work of evaluating the business environment of 10,000 private enterprises.
26. Carry out special actions such as "cracking down on counterfeits and cracking down", and lawfully crack down on the "online black mouths" and "black industrial chains" of private enterprises and entrepreneurs who deliberately speculate, spread rumors, and smear them.
27. Incorporate the implementation of support for the development of private economy in various regions into the annual comprehensive inspection of the State Council, supervise and rectify the problems found, and promote good experiences and practices. Establish a special reward and support fund for promoting private investment within the central budget, and provide reward and support to a group of cities and counties with fast growth, high proportion, strong vitality, and practical measures for private investment every year.
28. In accordance with relevant national regulations, collectives and individuals who have made outstanding contributions to the development of the private economy shall be commended and rewarded, and the entrepreneurial spirit shall be promoted to play a leading role as an advanced benchmark.
