Ministry of Education: Off campus training institutions are not allowed to hire employees with information on sexual assault, illegal or criminal activities
In order to implement the requirements of the Law on the Protection of Minors for close contact with the entry inquiry of minors in the industry, the Ministry of Education has piloted the entry inquiry of employees in off campus training institutions in Shanghai, Guangzhou, Zhengzhou, and Weihai this year, and has dealt with individuals who have a criminal record of sexual assault in accordance with the law. Recently, on the basis of preliminary pilot projects, the General Office of the Ministry of Education issued a notice on doing a good job in searching for the admission of employees in off campus training institutions, comprehensively promoting the system of searching for the admission of employees in off campus training institutions, and ensuring the entry of employees.
The notice emphasizes the full coverage of admission inquiries for all personnel. Implement the requirements of the employment inquiry and prohibition system for close contact with minors in the industry, and require all types of off campus training institutions to conduct admission inquiries for proposed employees, including teaching personnel, research personnel, and other personnel. For employees who have joined the company, regular centralized inquiries should also be conducted to ensure that all institutional employees who come into contact with minors are thoroughly investigated and that the safety bottom line for off campus training is maintained.
The notice emphasizes that the search work is carried out in accordance with the law and regulations. The access inquiry work is carried out in accordance with laws and policies such as the Law on the Protection of Minors and the Opinions on Implementing the System of Prohibitions from Employment, strictly regulating the inquiry process and protecting the rights and obligations of relevant parties in accordance with the law. Training institutions must obtain the consent of the respondent and submit relevant materials when applying for queries, and are not allowed to query the record information of non applicants without authorization. Standardize the use of search results. If sexual assault records are found through the search, the institution shall not hire them; If the query object has objections to the results, they can apply for a review according to the procedure.
The notice emphasizes strict responsibility for query management. Education departments at all levels, relevant supervisory departments, off campus training institutions and their staff should fulfill their legal responsibilities for access inquiries. If there are situations such as "failure to investigate", "violation of regulations on duty", "leakage of privacy", as well as negligence, abuse of power, and favoritism, they will be dealt with in accordance with the law and regulations, and relevant units and personnel will be held accountable.
Next, the Ministry of Education will guide and supervise various regions to implement the work of access inquiry for practitioners, rely on the national off campus education and training supervision and service platform, regularly carry out centralized inquiries of illegal and criminal information such as sexual assault by practitioners, and weave a dense safety protection network for off campus training.
