Ministry of Commerce: Termination of anti-dumping and countervailing duties on imported barley originating from Australia
On May 18, 2020, the Ministry of Commerce issued Announcement No. 14 and No. 15 of 2020, deciding to impose anti-dumping and countervailing duties on imported barley originating from Australia, with an implementation period of 5 years from May 19, 2020.
On April 14, 2023, at the request of the China Liquor Industry Association, the Ministry of Commerce issued Announcement No. 12 of 2023, which decided to review the necessity of continuing to impose anti-dumping and countervailing duties on imported barley originating from Australia. After investigation, in accordance with Article 49 of the Anti Dumping Regulations of the People's Republic of China and Article 48 of the Anti Subsidy Regulations of the People's Republic of China, the Ministry of Commerce has made a review ruling. The relevant matters are hereby announced as follows:
1、 Review ruling
The Ministry of Commerce has ruled that due to changes in the Chinese barley market, it is no longer necessary to continue imposing anti-dumping and countervailing duties on imported barley originating from Australia.
2、 Cancel anti-dumping and countervailing duties
According to Article 50 of the Anti Dumping Regulations of the People's Republic of China and Article 49 of the Anti Subsidy Regulations of the People's Republic of China, the Ministry of Commerce has proposed to the State Council Tariff and Tariff Commission to abolish anti-dumping and countervailing duties. Based on the suggestion of the Ministry of Commerce, the State Council Tariff and Tariff Commission has made a decision to terminate the anti-dumping and countervailing duties on imported barley originating from Australia from August 5, 2023.
3、 Administrative Litigation and Administrative Reconsideration
According to Article 53 of the Anti Dumping Regulations of the People's Republic of China and Article 52 of the Anti Subsidy Regulations of the People's Republic of China, those who are dissatisfied with this review decision may apply for administrative reconsideration in accordance with the law or file a lawsuit with the people's court in accordance with the law.
This announcement shall come into effect on August 5, 2023.
