Kneeling for a retrial, Yu Huaying's trial in the case of trafficking 11 children directly hits: the victim will see human traffickers again in 27 years | Huaying | Yu Huaying
This is Yang Niuhua's second encounter with "human trafficker" Yu Huaying after being abducted 27 years ago.
At the trial site. On July 14th, the case of Yu Huaying suspected of child trafficking was heard in the Guiyang Intermediate People's Court in Guizhou. On this day, Yang Niuhua waited too long.
The prosecution accuses Yu Huaying of colluding with Gong Mouliang to seek illegal benefits during the period of 1993 to 1996, wandering around Guizhou Province, Chongqing City and other places, searching for suitable children for trafficking. After successful, the two of them took the abducted children to Handan City, Hebei Province, and through Wang Moufu's introduction, searched for buyers to buy and sell them, in order to make a profit. During this period, a total of 11 children were abducted and sold.
The trial began at 10am on the same day. Before the trial, many parents who had lost their children gathered at the entrance of the court, hoping to attract media attention while also paying attention to the trial of "human trafficker" Yu Huaying. In this trial, only one victim, Yang Niuhua, appeared in court, and two other victims entrusted lawyers to participate in the trial. Among the other eight victims, except for one whose whereabouts are unknown, the other seven did not participate in the trial.
The reporter from Pengpai News, along with the families of the victims and some parents seeking relatives, participated in the entire listening process. The Guiyang Intermediate People's Court formed a 7-person collegial panel to hear the case, consisting of one presiding judge, two judges, and four people's jurors.
The court investigation and debate were conducted during the trial. The prosecutor read out the indictment and supplementary prosecution decision, and both the prosecution and defense conducted evidence and cross examination. During the trial, Yu Huaying often said that he couldn't remember many details of the crime he committed back then. She admits to the crime of trafficking 11 children, but denies any acts of intimidation or abuse of abducted children during the trafficking process. The prosecution believes that Yu Huaying's behavior constitutes the crime of child trafficking, and the circumstances are particularly serious. It is recommended that Yu Huaying be sentenced to death. In the final statement stage, Yu Huaying apologized to the victims and their families, hoping that the collegiate bench would provide lenient sentencing.
After the trial, the presiding judge announced an adjournment and announced the verdict at a later date.
27 years from now, the trial: The abductees bid farewell to human traffickers with mixed emotions
At around 10:05 am on July 14th, Yu Huaying entered the court through the entrance next to Yang Niuhua. At the moment of seeing her enemy again, Yang Niuhua couldn't help but shed tears. Almost at the same time, Yang Niuhua, who was sitting in the audience seat, also cried.
According to the prosecution's allegations, Yang Niuhua is the seventh child abducted and trafficked by Yu Huaying since January 1993, and also the first girl abducted and trafficked by her. In the winter of 1995, Yang Niuhua, who was then 5 years old, was abducted by Yu Huaying in Guiyang, Guizhou. Since then, she has never seen Yu Huaying again. But 27 years have passed, and the appearance of Yu Huaying has always been deeply imprinted in Yang Niuhua's mind.
Yu Huaying, who is about to turn 60, has gray hair, a long face, high cheekbones, and sunken cheeks. When answering the presiding judge's question, Yu Huaying spoke dialects throughout the process. She said she is from Yunnan and of the Bai ethnic group, but when she reapplied for her ID card in Chongqing, her ethnicity was changed to Han.
When the presiding judge mentioned her daughter during interrogation, Yu Huaying choked up. In January 1987, Yu Huaying, who had just turned 23, gave birth to her daughter Wang Meihua with her husband Wang Mouwen. A few years later, while working outside, Yu Huaying met Gong Mouliang, who was 20 years older than her, and thus embarked on the criminal path of human trafficking. According to Yu Huaying's confession, the first child to be sold was the illegitimate child born during their cohabitation.
Regarding the sale of her illegitimate child with Gong Mouliang, Yu Huaying claimed in court that both she and Gong Mouliang had families and did not have the ability to raise children, so she sold the child to Handan, Hebei.
During the court investigation, the prosecutor, the presiding judge, the victim and their authorized representatives, and Yu Huaying's defense counsel each questioned Yu Huaying.

When answering questions about the time of the crime, the specific location of the rented property, the name of the landlord, the identity of the parents of the abducted child, and buyer information in each case, Yu Huaying almost said "I can't remember" and "I don't know". But for some plot points, Yu Huaying remembers them very clearly. For example, when the prosecutor asked Yu Huaying how much money he had sold for kidnapping two brothers in Zunyi, he clearly answered that one sold for 3800 yuan and the other sold for 4200 yuan. The prosecutor asked Yu Huaying if he had bought candy, popsicles, and other food for the children he abducted. Yu Huaying replied, "Yes.". The prosecutor asked if any other items were added to these foods, and Yu Huaying replied, "No". The prosecutor asked if they cried on the road after the child was abducted, and Yu Huaying replied, "No crying.".
In the stage of providing evidence and cross examination, Yu Huaying and her defense have basically no objection to the evidence presented by the prosecutor. Yang Niuhua and her authorized agent claimed that when Yang Niuhua was abducted, Yu Huaying threatened to throw her out of the car, kick her more than ten feet, and scald her head with boiling water because she didn't listen. Yu Huaying denied this and claimed that she had never abused the abducted child. Yang Niuhua's representative believes that in the absence of Yu Huaying giving sleeping pills or other items to the abducted children, it is impossible for all 11 abducted children to cry or make noise for several days or even more. The only reasonable explanation is that Yu Huaying did not truthfully confess all of his crimes.
Late apology: The prosecutor suggests the death penalty, while the defendant requests a lighter sentence
During the trial, Yu Huaying twice expressed apologies to the victims and their families: once, while defending herself, Yu Huaying clasped her hands and said "I'm sorry"; Another time, in the final statement, Yu Huaying stated that he had pleaded guilty and repented, hoping that the court could impose a lighter punishment.
During the court debate, the prosecutor stated that Yu Huaying had abducted and sold a total of 11 children multiple times in order to seek illegal benefits. The facts of the crime were clear, and the evidence was reliable and sufficient. Therefore, he should be held criminally responsible for the crime of child trafficking. Due to the particularly serious criminal circumstances of Yu Huaying, the prosecutor suggested in court that the collegiate bench sentence Yu Huaying to death.
Yu Huaying's defense has no objection to the prosecutor's accusation that Yu Huaying committed the crime of child trafficking. However, in terms of sentencing, it is hoped that the collegiate bench will fully consider the position and role played by Yu Huaying in each case, as well as the fact that Yu Huaying has not committed any illegal child trafficking since his release from prison in 2009, and make a discretionary judgment.
Afterwards, the prosecutor responded to the defense opinions of Yu Huaying's defense counsel and reiterated their recommendation that the collegiate bench sentence Yu Huaying to death.
In this case, the representatives of the three victims agreed with the prosecution's conviction and sentencing recommendations, and reiterated that Yu Huaying's actions have caused great harm to the victims and their families, and that they will not switch back to saying "it's okay" just because Yu Huaying said "I'm sorry". Yang Niuhua's representative also stated that Yu Huaying was sentenced in 2004, and from this trial, it can be seen that the previous criminal punishment did not make Yu Huaying aware of her conscience and voluntarily confess her crimes. The multiple criminal facts accused by the prosecution this time were only admitted by Yu Huaying after being interrogated by the police, indicating that Yu Huaying did not confess or repent before.
When it was Yang Niuhua's turn to speak, she suddenly stood up, knelt down on the spot, and cried, requesting the court to sentence Yu Huaying heavily.
After the criminal part of the case was tried, the collegiate bench conducted a trial of the civil part attached to the case. The three criminal plaintiffs in this case filed compensation claims of over 400000 yuan, over 400000 yuan, and over 8.81 million yuan respectively. Yu Huaying stated that she is willing to compensate the victim, but lacks the ability to do so. Yu Huaying said that she still has an empty brick and tile house in her hometown, but has not obtained a property ownership certificate.
Pengpai News once went to the house mentioned by Yu Huaying on the eve of the court hearing. This was built by her and her husband Wang Mouwen after their marriage, and it is now abandoned due to being uninhabited for a long time. The weeds in front of the courtyard have not been cleared and have grown to two meters high.
At the end of the trial, the court announced an adjournment and announced the verdict at a later date.
