Has the founding major general become a "revolutionary traitor"? Family member: will hold self media legally responsible, lady | photo | revolution
On August 11th, Ms. Shi, the granddaughter of the founding general He Kexi, posted on social media that her grandfather's photo had been stolen and shared by self media, and she had falsely claimed to be a "revolutionary traitor".
Ms. Shi and her family are extremely angry about this behavior, stating that the relevant self media are suspected of slandering heroes. Various evidence collection has been completed, and relevant departments have been notified. The next step is to report the case and hold the self media legally responsible.
According to the Zhejiang Daily, He Kexi, a native of Emei, Sichuan, joined the CPC in 1929, and then began a 53 year revolutionary career. In April 1949, He Kexi led his troops to participate in the battle to liberate Nanjing. In 1955, he was awarded the rank of Major General, the First Order of Independence and Freedom, and the First Order of Liberation. In 1966, He Kexi went to work in Zhejiang and served as the Vice Chairman of the Zhejiang Provincial Political Consultative Conference until his death. At 18:30 on December 17, 1982, Comrade He Kexi passed away in Hangzhou due to a sudden heart attack at the age of 76.
On August 16th, a journalist from Chao News contacted Ms. Shang Shi to inquire about the details.
"In early August, my family received a phone call from the Party History Research Office of the Ningbo Municipal Party Committee. They discovered that some self media had used photos of my grandfather to post on the internet and made inappropriate comments, which may be suspected of defaming, insulting, and defaming martyrs." Ms. Shi said, and based on the clues, her family began searching for relevant articles or videos on various social media platforms.

After searching for a few days, Ms. Shi found that most self media accounts posted videos related to her grandfather, which were basically the same. "Self media arranged the top ten worst traitors of the Communist Party of China on their own, accompanied by introductions, names, etc., and made them into videos. Among them, when the Gu Shunzhang column appeared, the corresponding photo was of my grandfather He Kexi when he was young, accompanied by the text 'the most dangerous traitor in the history of the Communist Party of China'."
According to public information, Gu Shunzhang once served as a member of the Political Bureau of the Communist Party of China Central Committee, alternate member of the Political Bureau of the Communist Party of China Central Committee, and head of the Central Special Forces. In 1931, he was arrested and rebelled in Wuhan, causing serious harm to the Communist Party of China.
In order to prove that the photo is from Grandpa He Kexi, Ms. Shi and her family found a certificate photo of the First Class Liberation Medal belonging to the elderly person, and the photo on it is consistent with the avatar in the video. "This photo should have been taken during the award ceremony in 1955. In addition, it is also included in the commemorative album of my grandfather's 115th anniversary."
According to Ms. Shi's incomplete statistics, these videos were reposted or published on 8 different social media platforms on 22 self media accounts, with the earliest video being released in April this year. Ms. Shi and her family expressed confusion about the behavior of these self media accounts, saying, "Why would you associate my grandfather's photo with Gu Shunzhang? It not only harms my grandfather, but also our whole family."
After the incident, Ms. Shi and her family went to her grandfather's former employer and the Zhejiang Provincial Archives to retrieve historical materials to prove his identity as a revolutionary veteran. "The first-class revolutionary medal, military rank order, and Zhejiang Daily's report on Comrade He Kexi's memorial service held in Hangzhou archived by the archives can all prove my grandfather's identity as a revolutionary veteran. We have retained relevant evidence and will hold the publisher and platform accountable."

On the afternoon of the 16th, a journalist from Chao News consulted Meng Bo, a lawyer at Beijing Jingshi Law Firm, regarding this matter.
"According to the provisions of the Law of the People's Republic of China on the Protection of Heroes and Martyrs, it is prohibited to distort, vilify, desecrate, or deny the deeds and spirit of heroes and martyrs. The names, portraits, reputations, and honors of heroes and martyrs are protected by law. No organization or individual may infringe upon the names, portraits, reputations, and honors of heroes and martyrs in public places, on the Internet, or by using radio, television, movies, and publications, by insulting, slandering, or otherwise." Meng Bo said that if the public security, culture, press and publication, radio, television, movies, Internet information, market supervision and administration, and the departments responsible for the protection of heroes and martyrs find the above acts, they should deal with them in a timely manner according to law.
Meng Bo stated that if network operators discover that their users have posted information that insults, defames, or otherwise infringes on the name, portrait, reputation, or honor of heroes and martyrs, they should immediately stop transmitting the information, take measures such as elimination, prevent information dissemination, keep relevant records, and report to the relevant competent authorities.
