Half a year later, the prosecution decided not to prosecute, and the man was beaten by multiple people before being arrested. Yang | Liu Cunjin | man
Liu Cunjin finally received the decision not to prosecute.
He is 34 years old and from Wenshang County, Jining, Shandong Province. He has been under bail pending trial, arrest, residential surveillance, and release of residential surveillance since June last year on suspicion of intentional injury.
According to a report by Jiupai News, the non prosecution decision issued by the Wenshang County Prosecutor's Office shows that the investigation of this case was concluded by the Wenshang County Public Security Bureau. The non prosecuted person Liu Cunjin was suspected of intentional injury and was transferred to this court for prosecution on July 26, 2022. On August 5 of the same year, this court filed a public prosecution with the Wenshang County Court, and on April 25, 2023, the court withdrew the prosecution.
The reporter learned from the decision not to sue that on October 24, 2021, at around 19:00, Liu Cunjin had a conflict with Yang and others who were dining at a restaurant due to trivial matters. Yang and others first started beating Liu Cunjin and others. After being dissuaded by others, Yang and others continued to fight against Liu, and Liu Cunjin counterattacked, causing Yang to have bilateral nasal bone fractures. The prosecution believes that Liu Cunjin has no criminal facts and has decided not to prosecute him.
According to the previous indictment, on the day of the incident, Liu Cunjin was eating at a restaurant when he was stopped by Yang and others while hugging the owner's wife. Later, the two sides had an argument and fought, resulting in Yang's bilateral nasal bone fractures. After assessment, the injury was classified as minor injury level 2, while Liu Cunjin suffered minor injuries.
Liu Cunjin insisted that he did not engage in any indecent behavior that night, nor did he harm the other party. On August 19th, he stated in an interview with reporters that he had been detained for nearly half a year due to this matter. Although he has now obtained his innocence, he hopes to receive compensation.
"They pulled me to the corner and beat me up again."
Liu Cunjin: I am a grain farmer. In October 2021, it rained in Jining, and I wanted to take out the 1000 acres of corn land I contracted to sun dry. So I recruited a few people from the labor market to help. I saw that they were too busy and tired, so I invited them to a restaurant for a meal. Yang and his team are also in the store. On my way back to the dining table, I don't know why they were cursing at me, but I didn't mind either.
That restaurant is right at the entrance of our community. I am very familiar with the boss and his wife, and they usually help them with some work when they are busy. That day we ran out of food, so I went to find the boss's wife to add some dishes. Because there were many people and the aisle was narrow, when I went back, I grabbed the boss's wife with both hands and slipped past her from behind.
This action has no pause, and it is under surveillance. I have no indecent behavior or remarks. Neither the boss nor the boss's wife expressed any dissatisfaction or discomfort.
Liu Cunjin: When I returned to my seat, I picked up Mantou and continued to eat. A man suddenly came to Yang's table and challenged me, saying that he would beat me. I asked him why he wanted to beat me up, and they started cursing. Someone said, "I can't afford to beat you.".
Then about six people came up together to beat me up, using benches, wine bottles, and iron spoons. I later found out that he was a relative of the boss who took several turns.
Liu Cunjin: Yes, the people present at the argument have separated us. I called the police and said to them, "Don't leave, I called the police.". Then they pulled me to the corner and beat me up again.
Liu Cunjin: I have counterattacks, but they are all ineffective actions and I didn't hit them. We have all cross examined during the trial.
Liu Cunjin: I was beaten to the point where my head was bleeding and my head was broken. There were obvious scars on my arms and body, and my stomach also felt swollen after being kicked. I only know that one of them had a broken head, but it's definitely not me who caused it. Maybe they accidentally injured themselves when they hit me.
"Let me plead guilty. You can provide evidence."
Liu Cunjin: On that day, the police said it had been recorded and asked us to go to the hospital for treatment separately. I went to the hospital to get bandaged, thinking about it and asking the police to evaluate it. There was still a lot of work to do in my field, so I went to work later.

Liu Cunjin: Ten or twenty days after the incident, the direction of the police officers at the police station changed and asked me to reconcile with the other party.
Liu Cunjin: I don't accept it. During this period, they still relied on connections to find someone to come to me and tell me to resolve this matter. I asked how to deal with it, and he said we don't look for each other, which means neither of us is responsible, and I got beaten up for nothing. I say this is not realistic.
He said it's not easy to handle, there are minor injuries on their side. I said that minor injuries were not caused by me. Since that's the case, let's handle it as a matter of business. You can provide evidence that it was caused by me. I should compensate for it and bear legal responsibility.
Liu Cunjin: They have claimed 300000 yuan from me and said if they don't pay, they will arrest me. Let me plead guilty. You can provide evidence. When and which action caused his injury, bring out surveillance footage.
Liu Cunjin: It's a magical thing. On July 26, 2022, the Wenshang County Prosecutor's Office released me on bail pending trial, but three days later, the prosecutor's office decided to arrest me, and I was arrested. Then I was detained for almost half a year.
"I would rather be acquitted"
Liu Cunjin: They made me confess, but I insisted on not. I said, "If you don't arrest me, you will arrest me.". I didn't do this, I can't admit this crime. I may not be able to leave much wealth for my child in this lifetime, but I want to keep my own innocence.
Liu Cunjin: Yes, I did. I had one trial in February this year on the charge of intentional injury. The trial lasted for two consecutive days without a verdict. After the trial, the prosecutor's office suspended the case and returned it for supplementary investigation.
I originally planned to have another trial on April 27th, but the court notified me on April 26th that the prosecutor's office had withdrawn the case. After about a month, the prosecutor's office issued a non prosecution decision.
Liu Cunjin: It's okay, but I would rather be acquitted.
Liu Cunjin's Certificate of No Criminal Record
Liu Cunjin: I want to hold those who hit me accountable and investigate the truth, such as what happened to Yang's nose injury. Another thing is to apply for national compensation.
Liu Cunjin: The impact is still significant. One is a change in mindset. When I was detained, my values and outlook on life changed. Although I don't have a high level of education, my teacher taught me to be daring and not afraid of trouble. I have always believed in the law.
I am very sorry for my family. I was unable to be by my child's side, nor was I able to pay homage to my mother on her one-year anniversary. I feel very guilty.
Another thing is the land I contracted. During this period, because my family cannot take care of it, there is basically no harvest.
