The buyer's right to refund cannot be unilaterally restricted
Feng Tao, a lawyer from Shaanxi Suoji Law Firm, believes that according to Article 496 (1) of the Civil Code, "Standard terms are clauses pre drafted by the parties for repeated use and not negotiated with the other party at the time of contract signing." Therefore, the ticketing platform stipulates that tickets cannot be refunded or modified, or a 30% handling fee is charged for refunds, which are standard terms. Meanwhile, according to Article 497 (2) of the Civil Code, if one of the following situations occurs, the standard clause is invalid: the party providing the standard clause unreasonably exempts or reduces its liability, increases the other party's liability, or restricts the other party's main rights. Therefore, the unilateral restriction of the ticket platform on the buyer's right to refund may be deemed as an unreasonable increase in the buyer's responsibility, resulting in the invalidity of this clause.
Furthermore, scalpers are illegal under the law. According to Article 52 (3) of the Public Security Administration Punishment Law, those who forge, alter, or resell train tickets, ship tickets, air tickets, cultural performance tickets, sports competition admission tickets, or other valuable tickets or vouchers shall be detained for not less than ten days but not more than fifteen days and fined not less than five hundred yuan but not more than one thousand yuan; Those with minor circumstances shall be detained for no more than five days or fined no more than 500 yuan.
