In order to effectively deter illegal activities, fully leverage the role of case interpretation, education warning, and social public opinion supervision, a batch of typical cases are selected for exposure.

1、 The Pudong Branch of Shanghai Public Security Bureau has cracked down on the illegal operation of hazardous chemicals by 11 people including Zhou Mouxian

On May 25, 2023, the Pudong branch cracked a case of illegal operation of hazardous chemicals, arresting a total of 11 individuals involved, including Zhou and Chen, and seizing more than 20 tons of industrial methanol and other hazardous chemicals. After investigation, Zhou and Chen, without obtaining a hazardous chemical business license, illegally purchased a large amount of industrial methanol from Taicang and other places in Jiangsu, and stored it in two privately built warehouses in Pudong District; Recruiting 9 distribution personnel to sell and transport industrial methanol to restaurants through social media and other means, impersonating "environmentally friendly oil" to illegally profit from it. The acts of 11 suspect, including Zhou Mouxian and Chen Moufeng, have violated the provisions of Article 225 of the Criminal Law of the People's Republic of China and are suspected of illegal business operations; In accordance with the provisions of Article 82 of the Criminal Procedure Law of the People's Republic of China, 11 suspect, including Zhou and Chen, were detained in advance according to law, 7 of them were guaranteed, and 4 were prosecuted.

3、 Emergency Management Bureau of Qi County, Kaifeng City, Henan Province investigates and deals with the case of unlicensed sales of hazardous chemicals

On April 13, 2023, law enforcement officers from the Emergency Management Bureau of Qi County, Kaifeng City discovered that someone was promoting the use of mobile oil tankers to sell diesel on a certain social media platform through video advertising. After verification, a tank truck storing hazardous chemicals was parked in a commercial concrete station yard in Qixian County. On site measurements showed that there was still 300L of diesel in the tank. Liu saw a promotional advertisement from the manufacturer on social media, claiming to sell legal gas vehicles with complete procedures. So Liu bought a car and used social media to sell diesel. The fuel buyer placed an order, paid or paid in cash through social media. The party involved, Liu, engaged in unauthorized and unlicensed operation of hazardous chemicals, which violated the provisions of Article 33, Paragraph 1 of the Regulations on the Safety Management of Hazardous Chemicals. In accordance with the provisions of Article 77, Paragraph 3 of the Regulations on the Safety Management of Hazardous Chemicals, the Emergency Management Bureau of Qi County ordered him to stop his illegal operation, confiscate 300L of diesel and 9860 yuan of illegal gains, and impose an administrative penalty of RMB 100500.

On February 27, 2023, the Emergency Management Bureau of Gusu District, Suzhou City, Jiangsu Province received a report letter from the Beijing Economic and Technological Development Zone Management Committee, reflecting that Suzhou Dongwu Glass Instrument Co., Ltd. is suspected of illegally selling hazardous chemicals on e-commerce platforms. After investigation, the company registered a "Dongwu Industrial Products" exclusive store on the e-commerce platform and released sales information for the product barium chloride in March 2022. During the shelving period of barium chloride, there were no illegal sales records or illegal gains. Barium chloride is a hazardous chemical listed in the List of Hazardous Chemicals and is not within the scope of the company's hazardous chemical business license. According to Article 77, Paragraph 3 of the Regulations on the Safety Management of Hazardous Chemicals, the company shall be fined RMB 107500 as an administrative penalty.

5、 The Market Supervision Bureau of Zhuzhou City, Hunan Province investigated and dealt with the case of Zhuzhou Xingkong Chemical Glass Co., Ltd. producing hazardous chemicals without a certificate

On February 7, 2023, the Market Supervision Bureau of Zhuzhou City received a letter from the Hunan Provincial Market Supervision Bureau regarding the submission of clues related to illegal product quality, and initiated an investigation into the relevant clues. After investigation, in December 2022, Zhuzhou Xingkong Chemical Glass Co., Ltd. purchased 20000 kilograms of 98% nitric acid from a limited company in Hunan. The company produces 5500 kilograms of industrial grade nitric acid with a concentration of 65% -68% without obtaining the National Industrial Product Production License for industrial grade nitric acid. During the existence of the above-mentioned illegal activities, there was no external sales, no illegal gains, and the total value of the goods was 14874 yuan. The party involved has stopped producing the product. The behavior of the parties involved violates Article 5 of the Regulations on the Administration of Industrial Product Production Licenses of the People's Republic of China. On April 21, 2023, in accordance with Article 45 of the Regulations on the Administration of Industrial Product Production Licenses of the People's Republic of China, the Zhuzhou Municipal Market Supervision Bureau imposed an administrative penalty of confiscating 5500kg of industrial grade nitric acid with a concentration of 65% -68% and imposing a fine of RMB 14874 on the parties involved for producing products listed in the catalog without obtaining an industrial product production license.

6、 Market Supervision Bureau of Yuhang District, Hangzhou City, Zhejiang Province investigates and deals with false advertising cases involving hazardous chemicals

On May 16, 2023, the Market Supervision Bureau of Yuhang District conducted an investigation into the online store "Xinsheng Precious Metals" opened by the party Liu based on relevant clues. After investigation, the parties involved have published products and corresponding advertisements on the e-commerce platform for "60% 1000ml dilute sulfuric acid solution for primary school chemistry experimental laboratory" since December 8, 2022. After testing, the sulfate ion content of the product is less than 1%, which is inconsistent with the description of the online store. The purpose of promoting "60% dilute sulfuric acid" on the webpage is to facilitate product traffic, and the actual product is a self-made oil stain cleaner. As of May 16, 2023, the product was delisted and a total of 5492 units were sold. The behavior of the parties involved violates the provisions of Article 28, Paragraph 2, Item (a) of the Advertising Law of the People's Republic of China, and constitutes false advertising. According to Article 55, Paragraph 1 of the Advertising Law of the People's Republic of China, the Market Supervision Bureau of Yuhang District has imposed an administrative penalty of 10000 yuan on the party concerned for publishing false advertisements.

7、 Hangzhou Postal Administration Bureau in Zhejiang Province investigates and deals with the case of Hangzhou Yifeng Logistics Co., Ltd. illegally receiving and sending hazardous chemicals

On April 23, 2023, the Hangzhou Postal Administration conducted an investigation into Hangzhou Yifeng Logistics Co., Ltd.'s collection of parcels sent by an online store on an e-commerce platform.
