Recently, in Ma'anshan, Anhui, a villager posted a series of videos on a short video platform claiming that their mother's grave had been excavated by the construction party, and even the ashes could not be found, which attracted attention.
The reporter noticed that from multiple related videos released by the villager, there were mechanical equipment construction on site and a large amount of soil piled up. The villager also mentioned that in Danyang Town, Ma'anshan City, a local company called Ma'anshan Conch Green Building Materials dug up his mother's grave and couldn't even find her ashes. In a video with police staff present, the family also mentioned that this cannot be done without any notice. For this, the villager also felt very guilty: "Mom, we can't face you." His video location was repeatedly displayed in the project department of Ma'anshan Conch Green Building Materials Company.

The staff replied that there were indeed graves of relatives of villagers dug up, and they went to the scene to inspect. Regarding this matter, the district also contacted the village committee. However, the villagers were not from their village, but from Longshan Village. As far as they know, the construction area is located between Baifeng Village and Longshan Village, but the tomb is located in Longshan Village.

Shao Lei, Senior Partner of Beijing Kangda Law Firm, stated that Article 3 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Determination of Liability for Mental Damage Compensation in Civil Torts stipulates that if the name, portrait, reputation, honor, privacy, remains, bones, etc. of the deceased are infringed upon, and their close relatives file a lawsuit with the people's court requesting compensation for mental damage, the people's court shall support it in accordance with the law. Regarding the damage to graves, firstly, if the other party is intentional, it is suspected of violating the Public Security Administration Punishment Law.
Article 65, Paragraph 1 of this Law stipulates that those who intentionally damage or defile the graves of others shall be detained for not less than five days but not more than ten days; Those with serious circumstances shall be detained for not less than ten days but not more than fifteen days, and may also be fined not more than one thousand yuan. Secondly, if it is a non intentional negligent act, it constitutes an infringement on the personal interests of the deceased, causing mental damage to close relatives, and is considered an infringement. According to law, civil compensation responsibilities such as repair and compensation for mental damage should be borne.
