Article 1 In order to develop foreign relations, safeguard national sovereignty, security, and development interests, safeguard and develop the interests of the people, build a modern and powerful socialist country, realize the great rejuvenation of the Chinese nation, promote world peace and development, and promote the construction of a community with a shared future for mankind, in accordance with the Constitution, This Law is formulated.

Article 2 This Law is applicable to the the People's Republic of China in the development of diplomatic relations, exchanges and cooperation in the economic, cultural and other fields with all countries, and in the development of relations with the United Nations and other international organizations.

Article 3 the People's Republic of China adhere to the guidance of Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thinking of the "Three Represents", the scientific development concept, and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, develop foreign relations and promote friendly exchanges.

Article 4 the People's Republic of China adheres to an independent foreign policy of peace and the five principles of mutual respect for sovereignty and territorial integrity, mutual non-aggression, non-interference in each other's internal affairs, equality and mutual benefit, and peaceful coexistence.

The People's Republic of China adheres to the path of peaceful development, adheres to the basic national policy of opening up to the outside world, and pursues a strategy of mutual benefit and win-win opening up.

The People's Republic of China adheres to the purposes and principles of the United Nations Charter, maintains world peace and security, promotes global common development, and promotes the construction of a new type of international relations; Advocate for the peaceful resolution of international disputes, oppose the use or threat of force in international relations, oppose hegemonism and power politics; Adhere to the principle of equality for all countries, regardless of their size, strength, wealth, and status, and respect the development path and social system chosen independently by people of all countries.

Article 5 The external work of the the People's Republic of China shall adhere to the centralized and unified leadership of the Communist Party of China.

Article 6 State organs and armed forces, all political parties and people's organizations, enterprises, institutions and other social organizations, as well as citizens, have the responsibility and obligation to safeguard national sovereignty, security, dignity, honor and interests in foreign exchanges and cooperation.

Article 7 The State encourages active non-governmental friendly exchanges and cooperation with foreign countries.

Those who have made outstanding contributions in foreign exchanges and cooperation shall be commended and rewarded in accordance with relevant national regulations.

Article 8 Any organization or individual that violates this Law and relevant laws and engages in activities that harm the interests of the State in foreign exchanges shall be investigated for legal responsibility in accordance with the law.

Chapter II Functions and Powders in Foreign Relations

Article 9 the central leading body for foreign affairs shall be responsible for the decision-making, discussion and coordination of foreign affairs, study, formulate and guide the implementation of the national foreign strategy and relevant major principles and policies, and be responsible for the top-level design, overall coordination, overall promotion and supervision of the implementation of foreign affairs.

Article 10 The National People's Congress and its Standing Committee ratify and abrogate treaties and important agreements concluded with foreign states, and exercise the functions and powers of foreign relations prescribed by the Constitution and laws.

The National People's Congress and its Standing Committee actively engage in external exchanges, strengthen exchanges and cooperation with parliaments of various countries, international and regional parliamentary organizations.

Article 11 The Chairman of the the People's Republic of China shall represent the the People's Republic of China, conduct state activities and exercise the powers of foreign relations as prescribed by the Constitution and laws.

Article 12 The State Council shall administer foreign affairs, conclude treaties and agreements with foreign countries and exercise the functions and powers of foreign relations prescribed by the Constitution and laws.

Article 13 The Central Military Commission shall organize international military exchanges and cooperation and exercise the functions and powers of foreign relations stipulated by the Constitution and laws.

Article 14 The Ministry of Foreign Affairs of the the People's Republic of China shall handle foreign affairs in accordance with the law and undertake diplomatic exchanges between party and state leaders and foreign leaders. The Ministry of Foreign Affairs strengthens the guidance, coordination, management and services for foreign exchanges and cooperation among various departments and regions of state organs.

Central and state organs carry out foreign exchanges and cooperation in accordance with their respective responsibilities.

Article 15 Foreign representatives of the People's Republic of China diplomatic missions stationed abroad, such as embassies and consulates in foreign countries and permanent missions to the United Nations and other international intergovernmental organizations, shall be the People's Republic of China.

The Ministry of Foreign Affairs exercises unified leadership over the work of diplomatic agencies stationed abroad.

Article 16 Provinces, autonomous regions and municipalities directly under the Central Government shall carry out foreign exchanges and cooperation within specific areas as authorized by the Central Government.

The people's governments of provinces, autonomous regions, and municipalities directly under the central government shall handle foreign exchange and cooperation affairs within their respective administrative regions in accordance with their powers.

Chapter III Objectives and Tasks for the Development of Foreign Relations

Article 17 The the People's Republic of China shall develop foreign relations, uphold the socialist system with Chinese characteristics, safeguard national sovereignty, unity and territorial integrity, and serve the country's economic and social development.

Article 18 the People's Republic of China promote the implementation of the Global Development Initiative, the Global Security Initiative and the Global Civilization Initiative, and promote an all-round, multi-level, wide-ranging and three-dimensional layout of external work.

The People's Republic of China promotes coordination and positive interaction among major powers, develops relations with neighboring countries in accordance with the principles of friendship, sincerity, mutual benefit, and friendship with neighbors, upholds the principles of genuine sincerity, righteousness, and profit, and unites and cooperates with developing countries, upholds and practices multilateralism, and participates in the reform and construction of the global governance system.

The People's Republic of China adheres to the global governance concept of consultation, co construction, and sharing, participates in the formulation of international rules, promotes the democratization of international relations, and promotes economic globalization towards openness, inclusiveness, inclusiveness, balance, and win-win.

Article 21 the People's Republic of China adhere to the global development concept of fairness and inclusiveness, openness and cooperation, comprehensive coordination, and innovation linkage, and promote the coordinated and sustainable development of economy, society, and environment and the all-round development of human beings.

Article 22 the People's Republic of China respects and protects human rights, adheres to the principle of universality of human rights in combination with its own reality, promotes the comprehensive and coordinated development of human rights, carries out international exchanges and cooperation in the field of human rights on the basis of equality and mutual respect, and promotes the healthy development of the international human rights cause.

Article 23 The the People's Republic of China advocates that all countries in the world transcend national, ethnic, and cultural differences and promote the common values of peace, development, fairness, justice, democracy, and freedom for all mankind.

Article 24 the People's Republic of China adhere to the civilization concept of equality, mutual learning, dialogue and inclusiveness, respect the diversity of civilizations, and promote exchanges and dialogue among different civilizations.

Article 25 the People's Republic of China actively participate in global environmental and climate governance, strengthen green and low-carbon international cooperation, jointly seek the construction of global ecological civilization, and promote the construction of a fair, reasonable, cooperative and win-win global environmental and climate governance system.

Article 26 The the People's Republic of China insists on promoting high-level opening up to the outside world, developing foreign trade, actively promoting and protecting foreign investment in accordance with the law, encouraging foreign economic cooperation such as foreign investment, promoting the high-quality development of the "Belt and Road", and safeguarding the multilateral trading system. Oppose unilateralism and protectionism, and promote the construction of an open world economy.

Article 27 The the People's Republic of China shall provide foreign assistance through economic, technological, material, human resources, management and other means to promote the economic development and social progress of developing countries, enhance their capacity for independent and sustainable development, and promote international development cooperation.

The People's Republic of China conducts international humanitarian cooperation and assistance, strengthens international cooperation in disaster prevention, reduction and relief, and assists relevant countries in responding to humanitarian emergencies.

The People's Republic of China adheres to respecting the sovereignty of other countries, non-interference in their internal affairs, and does not attach any political conditions when conducting foreign aid.

Article 28 The the People's Republic of China shall, in accordance with the needs of developing foreign relations, carry out exchanges and cooperation in the fields of education, science and technology, culture, health, sports, society, ecology, military, security, and the rule of law.

Chapter IV The System of External Relations

Article 29 The State shall make overall plans to promote the rule of law at home and abroad, strengthen legislation in foreign-related fields, and strengthen the construction of a foreign-related rule of law system.

Article 30 The State shall conclude or participate in treaties and agreements in accordance with the Constitution and laws and perform in good faith the obligations stipulated in the relevant treaties and agreements.

The treaties and agreements concluded or participated in by the state shall not conflict with the Constitution.

Article 31 The State shall take appropriate measures to implement and apply treaties and agreements.

The implementation and application of treaties and agreements shall not harm national sovereignty, security, and public interests.

Article 32 On the basis of observing the basic principles of international law and the basic norms of international relations, the State strengthens the implementation and application of laws and regulations in the field of foreign affairs, and takes law enforcement and judicial measures in accordance with the law to safeguard State sovereignty, security and development interests and protect the legitimate rights and interests of Chinese citizens and organizations.

Article 33 The the People's Republic of China shall have the right to take corresponding countermeasures and restrictions against acts that violate international law and the basic norms governing international relations and endanger the People's Republic of China sovereignty, security and development interests.

The State Council and its departments shall formulate necessary administrative regulations and departmental rules, establish corresponding work systems and mechanisms, strengthen departmental coordination, and determine and implement relevant countermeasures and restrictive measures.

The decision made in accordance with the first and second paragraphs of this article shall be final.

Article 34 the People's Republic of China shall establish and develop diplomatic relations with all countries in the world on the basis of the one-China principle and in accordance with the Five Principles of Peaceful Coexistence.

The People's Republic of China has the right to take necessary diplomatic actions such as changing or terminating diplomatic and consular relations in accordance with the treaties and agreements it has concluded or participated in, the basic principles of international law, and the basic norms of international relations.

Article 35 States take measures to implement binding sanctions resolutions and related measures of the United Nations Security Council under Chapter VII of the Charter of the United Nations.

The implementation of the sanctions resolutions and measures mentioned in the preceding paragraph shall be notified and announced by the Ministry of Foreign Affairs. The relevant departments of the state and the people's governments of provinces, autonomous regions, and municipalities directly under the central government shall take measures to implement them within their respective powers.

Organizations and individuals within China shall comply with the contents of the Ministry of Foreign Affairs announcement and relevant measures of various departments and regions, and shall not engage in any behavior that violates the above-mentioned sanctions resolutions and measures.

Article 36 The the People's Republic of China shall, in accordance with the relevant laws and treaties and agreements concluded or acceded to, grant corresponding privileges and immunities to foreign diplomatic agencies, foreign State officials, international organizations and their officials.

The People's Republic of China grants immunity to foreign countries and their property in accordance with relevant laws, treaties and agreements concluded or participated in.

Article 37 The State shall take necessary measures in accordance with the law to protect the security and legitimate rights and interests of Chinese citizens and organizations abroad, and to protect the overseas interests of the State from threats and infringements.

The country strengthens its overseas interest protection system, work mechanism, and capacity building.

Article 38 The the People's Republic of China shall protect the lawful rights and interests of foreigners and foreign organizations within Chinese territory in accordance with the law.

The state has the right to allow or refuse the entry or stay of foreigners, and manage the activities of foreign organizations within its territory in accordance with the law.

Foreigners and foreign organizations within China shall abide by Chinese laws and shall not endanger China's national security, harm public interests, or disrupt public order.

Article 39 the People's Republic of China strengthen multilateral and bilateral dialogues on the rule of law and promote exchanges and cooperation on the rule of law with foreign countries.

The People's Republic of China conducts international cooperation with foreign countries and international organizations in the field of law enforcement and justice based on treaties and agreements it has concluded or participated in, or on the principle of equality and mutual benefit.

The country deepens and expands the mechanism for external law enforcement cooperation, improves the judicial assistance system and mechanism, and promotes international cooperation in law enforcement and judicial fields. The country strengthens international cooperation in combating transnational crime and corruption.

Chapter V Safeguards for the Development of Foreign Relations

Article 40 The State shall improve the comprehensive guarantee system for foreign work and enhance the ability to develop foreign relations and safeguard national interests.

Article 41 The State guarantees the funds needed for foreign work and establishes a funding guarantee mechanism commensurate with the needs of developing foreign relations and the level of national economic development.

Article 42 The State shall strengthen the building of the contingent of foreign working personnel and take measures to promote the training, use, management, service and guarantee of talents.

Article 43 The State shall, through various forms, promote public understanding of and support for external work.

Article 44 The State promotes the building of international communication capacity, promotes the world to better understand and understand China, and promotes exchanges and mutual learning among human civilizations.

Chapter VI Supplementary Provisions

Article 45 This Law shall come into force as of July 1, 2023.
