In April 2021, Chen Mouzhi purchased a large amount of drug drinks from his previous home Chen Moulin. He cleverly packaged them into a new type of drink and claimed that the drink had a strong refreshing effect. After drinking it, he became ecstatic and promised that he would never become addicted, and it was generally undetectable, so he sold it to others.
At the request of Chen Moulin, Chen Mouzhi applied for a phone card in his own identity, opened a Alipay account and a WeChat account with the phone number, and gave the phone card and account to Chen Moulin for use. Within two months, Chen Moulin used the above Alipay account to collect the drug capital of 13600 yuan paid by his next family, and transferred it to Chen Mouzhi's bank card. Chen Mouzhi took the card to the bank to withdraw cash.
In a certain transaction, due to the buyer's inability to deliver in person, Chen Zhizhi handed over the purchased drinks to Meituan's errand rider to deliver them to the designated location, but was caught by public security personnel on the spot. After testing, it was found that the drink actually contains γ- A drug beverage containing hydroxybutyric acid. Subsequently, public security personnel seized 615 physical items of the drug beverage, totaling 147.35 kilograms, as well as 93 packages of caffeine containing drugs, totaling 2.86 kilograms, at the place where Chen Zhizhu was renting.
The prosecuting authority accuses Chen of committing the crimes of drug trafficking and money laundering, and has filed a public prosecution with the court.
Judgment result
The Guangzhou Intermediate People's Court ruled in the first instance that the defendant Chen was guilty of drug trafficking and money laundering, and was punished for multiple crimes. He was sentenced to 13 years and 6 months in prison and fined RMB 78000.
Chen was not satisfied and filed an appeal.
The second instance ruling of the Guangdong Provincial High People's Court rejects the appeal and upholds the original judgment.

γ- Hydroxybutyric acid has a strong inhibitory effect on the central nervous system and is currently the first category of psychotropic drugs regulated in China, belonging to the category of synthetic drugs.
In recent years, some places have seen a batch of drinks packaged under common brands such as "Shenxian Water", "Thai Red Bull", "Milk Tea", and "Cola". These drinks may seem common, but in reality, they are packaged under different brands γ- A drug beverage mainly composed of hydroxybutyric acid.
Due to the deceptive nature of packaging, it is easy for people to have the wrong impression that drinking a little is not a problem. However, drinkers typically progress from drinking one bottle a few days to one or even a few bottles a day, and even feel uncomfortable and drowsy without drinking, ultimately becoming completely addicted.
In this case, Chen Mouzhi provided his phone card, WeChat account and Alipay account to other drug dealers for use, and helped to withdraw drug money, which is a drug crime of money laundering. From the perspective of judicial practice, some individuals, driven by profit seeking motives, are attracted by the small profits promised by drug criminals, or deceived by drug criminals, and lend their phone cards, WeChat accounts, or bank cards to provide assistance to drug dealers in receiving and transferring drug funds, making drug transactions covert.
