Recently, a lawsuit released by the 12309 China Prosecutors Network revealed that the former director of a hospital in Liangshan, Sichuan, designated a sales representative of a medical consumables company as the supplier of the consumables. After receiving the payment, the medical representative sent a cash payment of 2.48 million yuan to the dean in proportion to 10% of the total sales amount of consumables.
The above indictment shows that from 2008 to 2021, in order to seek illegitimate benefits, Huang Jian, a sales representative of a medical consumables company, sent a total of RMB 3.375 million to Gu Xiande, former Secretary of the Party General Branch and Dean of Butuo County People's Hospital in Liangshan, Sichuan, and Tang Fangneng, former Secretary of the Party Branch and Dean of Butuo Zhongyi Hospital, through gratitude fees, kickbacks, and other means.
During the period from 2008 to 2021, Huang Jian delivered cash of 2.55 million yuan to Gu Xiande, the then director of Butuo County People's Hospital, in eight installments in order to seek illegitimate benefits in the sales of medical equipment, consumables, drugs, and other processes.
The indictment reveals that from the end of 2014 to the end of 2019, Gu Xiande took advantage of his position to privately inform Huang Jian of the purchasing needs of some consumables at Butuo County People's Hospital, and designated him as the supplier of the consumables at the Dean's Office meeting, resulting in a significant increase in the amount of consumables sold by Huang Jian at Butuo County People's Hospital. After receiving the payment, Huang Jian delivered cash of 2.48 million yuan to Gu Xiande five times in proportion to 10% of the total sales amount of consumables.
In addition, in January 2018, Huang Jian deposited 600000 yuan into his ex-wife Xu's account and immediately deposited it into the account of a securities brokerage limited liability company registered with Xu's ID card. He also gave the securities account, password, bank card, and U-shield to Gu Xiande, and gave the above 600000 yuan in the form of stocks to Gu Xiande.
The People's Procuratorate of Butuo County, Sichuan Province believes that in economic transactions, Huang Jian violated national regulations by giving state officials property in the name of kickbacks and gratitude fees. The circumstances are serious and he should be held criminally responsible for the crime of bribery.
In August last year, the "Clean Butuo" WeChat official account announced that Tang Fangneng, the former party branch secretary and president of the Central Yi Hospital in Butuo County, had been expelled from the party and public office for serious violations of discipline and law. One month later, Gu Xiande, former Secretary of the Party Branch and President of Butuo County People's Hospital, was also "double opened". After investigation, it was found that Gu Xiande lost his ideals and beliefs, had a weak sense of discipline and law, violated the spirit of the Central Eight point Regulations, and received gifts that may affect the fair execution of official duties; Agree for financial staff to privately deposit public funds for official expenses; Utilize the convenience of one's position to seek benefits and receive property for others in the procurement of medical consumables, with a particularly large amount.
