Chengdu Housing and Construction Bureau issues three consecutive articles!
On the evening of August 28th, the Chengdu Housing and Urban Rural Development Bureau in Sichuan Province issued three consecutive documents to optimize real estate policies.
One of the documents optimized the criteria for identifying households without housing, which states that if at least one registered homebuyer in a homebuyer family meets the housing purchase restriction policy in Chengdu and the homebuyer family does not own property rights in Chengdu, they are recognized as households without housing.
On August 29th, a reporter from Securities Times and Securities China consulted with Chengdu Real Estate Trading Center as a homebuyer. The staff stated that the previous rule was that only those who did not have a property transaction record within 2 years were considered to have no property. Now, as long as they do not have a property under their name, they are considered to have a basic need.
This means that Chengdu has relaxed the criteria for identifying households without houses. As for the loan policy, the above staff suggest asking the bank.
Subsequently, a reporter from Securities Times and Securities China consulted with the housing loan department of a branch of the Electric Power Bank in Chengdu. The staff stated that as long as there is no loan balance under the name of Chengdu, and the loan is settled, the first home policy will be implemented; If there is a loan that has not been settled, the second home policy will be implemented.
Industry insiders believe that the Chengdu policy cannot be understood as the implementation of the "house recognition but not loan recognition" policy for first homes, as it only emphasizes the verification of housing sales behavior.
Optimize the criteria for identifying households without houses
On the evening of August 28, according to the news from the official account of "Chengdu Housing and Urban Rural Development", the Bureau of Housing and Urban Rural Development of Chengdu Municipality and the Bureau of Justice of Chengdu Municipality issued the Supplementary Notice on Optimizing and Improving the Regulations on the Notarial Lottery of Commercial Housing, which will be implemented from August 29, 2023.
It is proposed to expand the self organized sales scope of development enterprises, and projects with a building area of 144 square meters or more or projects that have obtained a current sales filing opinion can no longer be subject to notarization and lottery.
At the same time, optimize the criteria for identifying households without housing. If at least one registered homebuyer meets the housing purchase restriction policy in Chengdu and the homebuyer does not have their own property rights in Chengdu, they will be recognized as a homeless resident family.
The Chengdu optimization's recognition of households without houses has been interpreted by some media as "recognizing houses but not loans". However, the Securities Times Securities China reporter learned that Chengdu's previous loan policy was to "recognize loans but not houses", that is, if there is a house but the loan has been settled, the first house loan policy will still be followed when purchasing another house. The meaning of "recognizing a house but not a loan" is that regardless of whether there has been a loan in the past, as long as there is no property under the current name, the first home loan policy can be implemented.

The staff stated that as long as there is no loan balance under Chengdu's name, that is, the housing loan is settled, the first home policy will be implemented, with a down payment of 30% and a loan interest rate of 4%; If there is a loan that has not been settled, the second home policy will be implemented, with a down payment of 40% and a loan interest rate of 4.8%.
This means that Chengdu still implements the policy of "recognizing loans but not houses".
Yan Yuejin, the research director of E-house Research Institute, also stated that the previous regulations in Chengdu for households without houses were that if the buyer and their family members did not have their own property rights housing in Chengdu and had no record of housing transfer within the two years before the registration of the purchase, they were recognized as households without houses. This time, the content of "no housing transfer records in the first two years" has been deleted, which means that "there will be no further verification of whether there is any housing sale behavior". This has effectively implemented the recent standards for the identification of first homes by departments such as the Ministry of Housing and Urban Rural Development. The regulation of the Ministry of Housing and Urban Rural Development is that those who do not have a complete set of housing under the local name can be considered as first homes. So this policy in Chengdu was one of the earliest in the country to relax the criteria for identifying first homes.
Yan Yuejin also pointed out that the Chengdu policy cannot be understood as the policy of "recognizing the first house but not the loan", because this situation in Chengdu is not necessarily related to the loan, it only emphasizes the verification of housing sales behavior.
Encourage sales of existing houses
On the same day, the Chengdu Housing and Urban Rural Development Bureau also issued a notice on supporting the sales of existing commercial housing and promoting high-quality development of the industry, as well as a notice on optimizing government services for the sales of commercial housing.
Among them, the Notice on Supporting the Sales of Existing Commercial Housing to Promote High Quality Development of the Industry proposes that the sales conditions are: completing the first registration of real estate; For the public service facilities that have been completed and have not yet been completed due to phased construction, a certificate of consent issued by the nearby public service facility management unit that can be used for transitional purposes and a written commitment to complete the supporting construction on time should be submitted, and the surrounding roads, sites, and isolation measures should be completed; Complete the construction content and planning verification content stated in the construction permit for the building where the application is located, complete the registration procedures for the delivery and use of new residential ancillary facilities and equipment, and ensure that the project receives what you see and delivers the property upon payment; Promise not to set up collateral during the sales phase; The minimum sales scale for existing houses is.
In terms of price declaration, it is proposed that for commercial housing projects such as land transfer contracts that do not specify the selling price of clean water and meet the conditions for selling existing houses, development enterprises can declare the selling price of clean water at a level not higher than the surrounding "double limited land" price limit.
In terms of strengthening supervision, it is proposed that development enterprises should stipulate in the sales contract of commercial housing that the buyer can deliver the commercial housing on the day when they pay the full purchase price; The housing and construction administrative departments in each district and county should increase their supervision and inspection efforts on the disclosure of sales information for commercial housing projects, and urge development enterprises to prominently display the sales record information and adverse factors of existing houses on the sales site.
In addition, it is proposed that departments such as housing and construction, finance, taxation, planning, and natural resources should study and formulate support policies such as credit, taxation, and real estate registration in accordance with their functional responsibilities, and encourage the sale of existing houses.
In addition, the Notice on Optimizing Government Services for the Sale of Commercial Housing proposes to improve the efficiency of soliciting inquiries for the sale of commercial housing, optimize the filing methods for finished residential decoration information, reasonably determine the minimum scale of pre-sale permits, and improve the management of online signature filing.
